Key Definitions
- Regional Office: The DOLE regional office with jurisdiction over the Jobs Fair.
- PESO: Public Employment Service Office with jurisdiction over the Jobs Fair.
- Requesting Party: Entity requesting to host or sponsor the Jobs Fair.
- Participating Entities: Employers, companies, licensed recruitment agencies, employment agencies for overseas employment, and registered contractors joining the Jobs Fair.
- PRPA: Licensed Private Recruitment and Placement Agency for local employment.
- PEA: Licensed Private Employment Agency for overseas employment.
- Registered Contractor/Subcontractor: Contractors registered under DOLE Department Order No. 10, s. 1997.
- Private Entity: Any legal individual, partnership, cooperative, or corporation under Philippine law.
- Educational Institution: Any private or public school under Philippine law.
- Jobs Fair: An event to connect job seekers with employers, recruitment agencies, and contractors at one venue and disseminate DOLE program information.
- Job Vacancies: Existing job openings listed by participating employers or agencies.
- Job Order: Overseas job vacancies approved by POEA.
- Various Reports: Jobs Fair Placement Report, Deployment Report, and Terminal Report detailing hires and placements to be submitted to DOLE and PESO.
Coverage
- Applies to all Jobs Fairs conducted, hosted, sponsored, or co-sponsored by NGOs, private entities, and educational institutions involving accredited employers, PRPAs, PEAs, or registered contractors.
Procedure Before the Jobs Fair
- Requesting Party must submit a written request to DOLE Regional Office with details on participating employers/agencies, licenses, job vacancies, and proposed schedule/venue at least 10 working days before the event.
- DOLE Regional Director conducts a venue inspection and verifies legitimacy of vacancies and licenses within 5 working days.
- Approval by DOLE Regional Director given within 5 working days from request receipt; PESO is notified.
Procedure During the Jobs Fair
- DOLE Regional Office and/or PESO representatives supervise the event to ensure compliance with laws.
- POEA representatives supervise when private employment agencies participating to ensure adherence to POEA rules.
- Jobs Fair procedures must be posted visibly at the venue.
Procedure After the Jobs Fair
- Participating entities must submit a Terminal Report before leaving the venue to PESO and POEA (if applicable).
- Placement Reports submitted monthly to DOLE Regional Office and PESO until final report is submitted.
- Deployment Reports by PEAs submitted to POEA, DOLE, and PESO within 90 days and thereafter monthly until final report.
- DOLE Regional Office consolidates reports for submission to DOLE Secretary.
Requirements for Participation
- Participating entities must have existing vacancies or approved job orders submitted at least 10 working days before the event.
- Recruitment agencies must have valid licenses: PRPA for local, POEA license and PRA for overseas employment.
- Job contractors must be DOLE-registered.
- Electronic recruitment entities must be registered with DOLE.
- Representatives must be authorized to make hiring decisions.
Prohibitions
- No Jobs Fair by private entities or NGOs without prior written DOLE Regional Director approval.
- No fees to be collected from job seekers at the Jobs Fair; placement and service fees governed by existing Rules on recruitment agencies.
- Advertisements require prior clearance from DOLE Regional Office; additional clearance from POEA if overseas jobs involved.
Jobs Fair by Educational Institutions
- May conduct Jobs Fairs without DOLE approval if:
- Solely for their students and new graduates.
- Conducted on their premises.
- Participating companies hire only their own staff.
- DOLE Regional Office or PESO may supervise and assist.
- Violations subject jobs fair to full guidelines.
Administrative Costs
- The requesting party is responsible for all administrative expenses related to the Jobs Fair.
Penalties
- Violations regarding local recruitment and placement punished under Articles 39 and 288 of the Labor Code.
- Violations related to overseas employment governed by Republic Act No. 8042 and POEA Rules.
- Penalties apply to participating recruitment/placement agencies.
Effectivity
- Guidelines effective 15 days after publication in two newspapers of general circulation.
