Definitions of Key Terms

  • Disabled Persons: Individuals suffering from mental, physical, or sensory impairments that restrict their ability to perform activities considered normal for humans.
  • Disability: A physical or mental impairment that substantially limits one or more functions, a record of such impairment, or being regarded as having such impairment.
  • Impairment: Loss, reduction, or abnormality of physiological or anatomical function or structure.

Minimum Requirements for Accessibility

Onboard Accessibility

  • At least one deck must have accessible ramps and passageways.
  • Access must be provided to gangways, galleys, toilets, bathrooms, safety equipment, and berths/cabins meeting specified size requirements.
  • Provision of at least ten (10) fixed berths and/or seats near gangway exits, appropriately marked.
  • Designated stations for disabled persons at gangplanks with identifying marks.
  • Exclusive lifejackets for disabled persons clearly marked.
  • At least two crew members must be designated coordinators onboard, wearing identifiable uniforms.
  • Passenger ferry vessels must have designated seating for disabled persons near gangways with markings.
  • Accessibility information posters must be posted at fixed berths and designated seats.

Waterfront Accessibility

  • Wheelchairs and stretchers must be available at the waterfront or port area.
  • Disabled Persons' stations must be established at booking offices.
  • At least two shore-based personnel from shipping companies designated as coordinators with appropriate identification.

Grant of Assistance to Disabled Persons

  • Disabled passengers have priority in boarding, disembarking, and using facilities.
  • Disabled persons on board shall be assisted by designated personnel.

Requirements for Availment of Privileges

  • Presentation of a valid identification card issued by the National Council for the Welfare of Disabled Persons (NCWDP) is required unless disability is visibly evident.

Procedures for Complaints and Violations

  • Complaints regarding refusal or abuse of privileges must be reported to the nearest Maritime Industry Authority (MARINA) office for action.

Penalties for Violations

  • First Violation: Fine between P50,000 and P100,000.
  • Subsequent Violations: Fine between P100,000 and P200,000.
  • Abuse of privileges also subject to penalties under RA 7277/BP 344 and their Implementing Rules and Regulations.

Repealing and Effectivity Clauses

  • Inconsistent existing rules are repealed or modified.
  • The guidelines take effect 15 days following publication in a newspaper of general circulation.
