General Provisions

Definitions

  • Marine Surveying: Includes maritime surveys, inspections, technical research for purposes such as classification, loadline assignment, marine insurance, maritime liens, certification, cost evaluation, etc.
  • Loadline Assignment: Calculation and marking of loadline drafts on vessels following PMMRR and international conventions
  • Certificate of Authority to Conduct Loadline Assignment: MARINA-issued document authorizing companies to conduct loadline surveys and issue loadline certificates

Qualification Requirements

  • Must have at least one licensed naval architect and marine engineer (RENAMARE)
  • Approving officer must also be a RENAMARE
  • Loadline surveyors require specific licenses and minimum experience in loadline survey work
  • Two loadline surveyors (one RENAMARE) must pass a MARINA exam and interview, except those previously appointed by PCG

Documentary Requirements

  • Registration certificates (SEC or DTI depending on entity type)
  • Articles of Incorporation/By-laws
  • List and bio-data of marine surveyors
  • Names and licenses of approving officers and surveyors
  • Additional documents for loadline assignment authority include appointments from classification societies and proof of examination passing

Procedure for Accreditation and Loadline Assignor Appointment

  • Written application with complete documentary requirements to MARINA
  • Incomplete documents result in application rejection and return
  • Accreditation certificate issued upon qualification and requirements fulfillment; loadline assignor appointment issued simultaneously or separately

Qualifying Examination

  • Annual exams conducted by MARINA Screening Committee
  • Committee composed of multi-disciplinary directors and a licensed naval architect/marine engineer
  • Exam details announced publicly, results published and posted at MARINA

Validity of Certificates

  • Accreditation certificates valid for 3 years
  • Loadline assignor appointments valid for 1 year
  • Both certificates are non-transferable and exclusive to holder use

Fees and Charges

  • Accreditation certificate fee: P800.00
  • Loadline assignor appointment fee: P400.00 (in addition to accreditation fee)
  • Fees exclude documentary stamps mandated by law

Reporting Requirements

  • Submit updated listings of marine surveyors within 15 days of changes
  • Notify replacement of approving officer within 15 days
  • Annual accomplishment report due first quarter following year
  • Reports must be originals or certified true copies

Withdrawal or Suspension of Operation

  • Prior written notice to MARINA required for withdrawal or suspension
  • Automatic cancellation of accreditation; certificate must be surrendered
  • New accreditation required before resuming operation

Sanctions and Penalties

  • Operating with expired accreditation/appointment: fines escalating from P100/day plus warning to P25,000 plus license non-renewal
  • Operating without valid accreditation/appointment: higher fines escalating from P200/day to P25,000
  • Violations of qualifications, regulations or laws: fines starting at P10,000 plus warnings up to cancellation of license and P25,000 fines

Repealing Clause

  • Inconsistent prior memoranda and issuances repealed, modified or amended accordingly

Effectivity

  • Takes effect 15 days after publication in the Official Gazette or newspaper of general circulation in the Philippines
