Constitutional and legal basis
- Section 18, Article VII of the Constitution identifies the President as Commander-in-Chief of all armed forces of the Philippines.
- Section 4, Article II of the Constitution authorizes the Government to call upon the people to defend the State and require citizens to render personal military service, under conditions provided by law.
- Executive Order No. 69 cites Executive Order No. 264 (s. 1987) as the law that created the Citizen Armed Forces Geographical Unit (CAFGU).
- Executive Order No. 69 relies on existing powers vested in the President by the Constitution and existing laws.
Purpose and policy statement
- Executive Order No. 69 recognizes that CAFGU Active Auxiliary (CAA) units complement and support the Armed Forces of the Philippines (AFP) in dealing with internal and external security threats.
- Executive Order No. 69 recognizes that CAA units support the AFP by providing vital military intelligence, joining operations, securing conflict-affected communities, and acting as first responders during natural disasters.
- Executive Order No. 69 provides financial support to recognize CAA members’ service in maintaining local peace and order and assisting in confronting local insurgencies, carried out at risk to CAA members and their families.
Eligibility and coverage rules
- Section 1 grants financial support in the amount of Seven Thousand Pesos (P7,000.00) per month to each member of a CAA unit who meets Section 2 conditions.
- Section 1 limits coverage to the months of November and December 2018.
- Section 2 entitles only duly-appointed CAA members appearing in the AFP roster to the financial support.
- Section 2 provides that members who are in the roster and appointed but are still undergoing training are entitled to a prorated portion of the financial support upon satisfactory completion of the prescribed training.
Amount, period, and funding source
- Section 1 sets the monthly financial support at P7,000.00.
- Section 1 covers the specific periods of November and December 2018.
- Section 3 provides that the funding requirements for November and December 2018 shall be sourced from the FY 2018 Contingent Fund.
Role of DBM for future funding
- Section 4 directs the Department of Budget and Management (DBM) to study and propose measures for the grant of financial support to qualified CAA members on a monthly basis.
- Section 4 directs DBM to identify funding sources against which the financial support may be charged.
- Section 4 subjects the proposed funding measures to applicable budgeting, accounting, and auditing laws, rules and regulations.
Separability, repeal, and implementation effect
- Section 5 provides a separability rule: if any provision is declared invalid or unconstitutional, the remaining provisions continue in full force and effect.
- Section 6 provides a repealing rule: all orders, rules, and regulations inconsistent with Executive Order No. 69 are repealed or modified accordingly.
