Installation and Capacity Limitations
- The grantee shall install and maintain ice plants and cold storage facilities in any or all of the covered cities and municipalities.
- The combined total daily production capacity of all ice plants must not exceed 1,000 tons.
- The total storage capacity of all cold storage facilities must not exceed 2,000 tons.
Standards of Machinery and Equipment
- All machinery, equipment, and appurtenances used by the grantee must be modern, safe, and first-class in all respects.
Commencement of Operations
- The grantee must commence ice manufacturing within two years from the Act's approval.
- Exceptions to this commencement period include force majeure events such as acts of God, martial law, riots, civil commotion, usurpation by military power, or any other uncontrollable cause.
- Failure to commence operations within the stipulated period, without such exceptional causes, results in the franchise becoming null and void.
Regulatory and Legislative Conditions
- The franchise is subject to Commonwealth Act No. 146, as amended, but only concerning rate fixing.
- The Congress reserves the right to amend, alter, or repeal the franchise as public interest may require.
Equalization Clause for Competing Franchises
- If a competitor—individual, association, or corporation—receives a similar franchise containing more favorable terms, those favorable terms automatically apply to this franchise.
- This provision ensures no competitive disadvantage to the grantee relative to other franchises granted by Congress.
Effectivity of the Act
- The Act takes effect immediately upon its approval by Congress.
