Presidential Decree No. 101 aims to regulate unauthorized operators of public utility motor vehicles in the Philippines to improve public safety and convenience, granting powers to the Board of Transportation to prescribe, redefine, or modify the lines, routes, or zones of service for operators.

Exercise of Powers by the Board

  • Must proceed promptly using methods akin to legislative inquiry.
  • Board may conduct investigations and studies independently or with assistance from government agencies such as the Bureau of Transportation, Philippine Constabulary, Department of Public Works and Communications, and others.
  • Can call conferences and require submission of relevant documents, position papers, data from affected operators or persons.

Limitations on the Exercise of Powers

  • The Board must adopt a just and reasonable system of priorities when redefining or modifying operating rights.
  • Obligation to minimize adverse effects on individuals or entities affected by changes.

Transitory Provisions for Enforcement

  • Six months after promulgation, a coordinated enforcement campaign involving the Board, Bureau, police forces, and prosecutors to eliminate and punish clandestine (unlawful) public utility vehicle operators.

Repeal of Inconsistent Laws

  • All laws, acts, executive orders, and regulations inconsistent with this Decree are expressly repealed.

Effectivity Clause

  • The Decree takes effect immediately upon issuance without delay.
