The Enlisted Men's Pay and Allowances Act of 1957 establishes new rates of pay and allowances for enlisted men of the Armed Forces of the Philippines, including additional pay for hazardous duty, combat, and overseas service, as well as provisions for reservists and trainees.

Legal basis and repeals

  • Section 21 provides that Republic Act No. 1831 repeals Republic Act No. 315.
  • Section 21 also repeals Sections 89 and 91 of Commonwealth Act No. 1, as amended.

Policy, purpose, and intent

  • Republic Act No. 1831 provides new rates of pay and allowances for enlisted men of the Armed Forces of the Philippines.

Scope: who gets covered

  • Section 2 provides that the Act applies only to enlisted men of the Regular Force.
  • Sections 4 to 13 are not applicable to enlisted men of PEFTOK nor to any other Philippine contingent, unit, or individual member of the AFP while on duty overseas on a mission involving actual, threatened or anticipated armed hostilities.
  • Enlisted men described in Section 2 while on such overseas armed hostilities duty receive rates as provided in Section 17.
  • Section 2 provides that the Act applies to reservists only as later indicated in Section 18.

Enlisted grades under the Act

Base pay and longevity pay rules

  • Section 4 sets the monthly base pay of enlisted men of the Regular Force not less than:
    • E-7 — PHP 121.00
    • E-6 — PHP 107.00
    • E-5 — PHP 88.00
    • E-4 — PHP 79.00
    • E-3 — PHP 73.00
    • E-2 — PHP 70.00
    • E-1 — PHP 68.00
  • Section 5 provides that enlisted men of the Regular Force receive longevity pay based on years of continuous active service, with monthly rates not less than those stated by grade and length of service.
  • Section 5 requires crediting continuous active service in:
    • any of the armed forces of the Philippines, of the United States prior to July 4, 1946, and/or
    • recognized guerrilla units,
      in computing longevity pay.
  • Section 5 provides that if an enlisted man reenlists within 60 days from honorable discharge from a prior enlistment, the years of service in both enlistments are added for longevity pay computation.
  • Section 5 prohibits payment of any back longevity pay for any period of service heretofore rendered.
  • Longevity pay tables (monthly rates “not less than”) are established by grade for the following service brackets:
    • E-7: 2.00 (3–6 yrs), 4.00 (6–9), 6.00 (9–12), 9.00 (12–15), 12.00 (15–18), 15.00 (18–21), 18.00 (21–24), 21.00 (Over 24)
    • E-6: 2.00, 4.00, 6.00, 8.00, 10.00, 13.00, 16.00, 19.00
    • E-5: 1.00, 3.00, 5.00, 7.00, 9.00, 11.00, 13.00, 15.00
    • E-4: 1.00, 2.00, 3.00, 4.00, 5.00, 7.00, 9.00, 11.00

Special pay: flying, mechanics, sea, hazardous, combat

  • Section 6 provides that enlisted men of the Air Force (except those receiving air mechanic’s pay, hazardous duty pay, combat pay or specialist’s pay) participating in regular and frequent aerial flights pursuant to orders by competent authority receive additional pay equivalent to 50% of base pay for their grades.
  • Section 7 provides that qualified first, second, and third class Air Force air mechanics (except those receiving flying pay, hazardous duty pay, combat pay or specialist’s pay and not exceeding 15% of the enlisted strength of the Air Force) when required by competent authority receive additional monthly pay of not less than:
    • first class — PHP 75.00
    • second class — PHP 50.00
    • third class — PHP 25.00
  • Section 8 provides that enlisted men of the Navy (except those receiving hazardous duty pay or combat pay) performing sea duty pursuant to orders by competent authority receive additional pay equivalent to 10% of base pay for their grades.
  • Section 9 provides that enlisted men (except those receiving flying pay, air mechanic’s pay, sea duty pay, combat pay or specialist’s pay) receive additional pay of 50% of base pay as prescribed by the Secretary of National Defense.
  • Section 10 provides that enlisted men (except those receiving flying pay, air mechanic’s pay, sea duty pay, hazardous duty pay or specialist’s pay) receive additional monthly pay of not less than PHP 10.00 while engaged in combat as defined in regulations prescribed by the Secretary of National Defense.

Specialist pay and overseas duty pay

  • Section 11 establishes specialist pay by requiring the Secretary of National Defense to prescribe regulations for rating enlisted men as specialists (except those receiving flying pay, air mechanic’s pay, hazardous duty pay or combat pay).
  • Section 11 provides that specialist pay rates are not less than:
    • First Class — PHP 75.00
    • Second Class — PHP 65.00
    • Third Class — PHP 55.00
    • Fourth Class — PHP 45.00
    • Fifth Class — PHP 35.00
    • Sixth Class — PHP 25.00
    • Seventh Class — PHP 20.00

  • Section 12 provides that enlisted men of the Navy on overseas service as defined in regulations prescribed by the Secretary of National Defense receive overseas pay equivalent to 50% of base pay.

Quarters, subsistence, clothing, and laundry allowances

  • Section 13 requires that, under regulations prescribed by the Secretary of National Defense, each enlisted man not furnished adequate quarters in kind for himself and/or dependents shall be granted a quarters allowance at monthly rates not less than the table values.
  • Section 13 establishes quarters allowance minimums based on grade, and whether the enlisted man has None, 1 to 4, or 5 or more dependents, and whether the rate is Provincial or City:

  • Section 13 defines dependents for purposes of the Act to include:
    • lawful wife;
    • unmarried legitimate children under 21 years;
    • unmarried step-children and adopted children under 21 years who are in fact dependent;
    • unmarried legitimate children, step-children and adopted children over 21 years who are incapable of self-support because of being mentally or physically defective and are in fact dependent for over half of their respective support.
  • Section 13 defines adequate quarters:
    • Without dependents: bed space and toilet facilities.
    • With dependents: a bedroom, sala-flining room, kitchenette, bath and toilet facilities.
  • Section 14 provides that enlisted men are entitled to rations, barracks accommodations, medical attendance, and clothing as may be prescribed in regulations.
  • Section 14 provides that each enlisted man not furnished rations in kind shall receive a basic subsistence allowance not less than PHP 1.00 per day; enlisted men of the Navy while assigned to sea duty are given an additional subsistence allowance not less than PHP 0.50 per day.

    • PHP 75.00 upon original enlistment or reenlistment; plus
    • PHP 10.00 per month; plus
    • an additional PHP 20.00 upon each reenlistment entered into within two months after discharge due to expiration of the enlisted term.
  • Section 16 provides that enlisted men whose regular duties require frequent appearances in public or frequent attendance at ceremonies receive laundry allowance not less than PHP 8.00 per month, under regulations prescribed by the Secretary of National Defense.

PEFTOK and other overseas armed hostilities pay

  • Section 17 provides that enlisted men of PEFTOK and any other Philippine contingent, unit or individual member of the AFP while on overseas duty on a mission involving actual, threatened or anticipated armed hostilities receive monthly base pay, overseas pay, and quarters allowance whose total shall not exceed the following maximums:
    • E-7 — PHP 420.00
    • E-6 — PHP 375.00
    • E-5 — PHP 291.00
    • E-4 — PHP 261.00
    • E-3 — PHP 225.00
    • E-2 — PHP 195.00
    • E-1 — PHP 180.00
  • Section 17 provides an overseas duty bonus of PHP 100.00 upon return to the Philippines from overseas service on the described armed-hostilities mission.
  • Section 17 prohibits payment of the overseas duty bonus to any person more than once.
  • Section 17 withholds the overseas duty bonus from any person who:
    • has been found guilty of violation of Articles of War 59, 60, 67, 76, 77, 78, 79, 82, 83, 87, or 93; or
    • is awaiting trial by court martial for violation of such Articles; or
    • is returned to the Philippines for discharge under conditions other than honorable.
  • Section 17 establishes family subsistence allowance payable once upon departure of the enlisted man from the Philippines, to the spouse (or in default of the spouse, specified dependents), at the following rates:
    • E-7 — PHP 480.00
    • E-6 — PHP 420.00
    • E-5 — PHP 340.00
    • E-4 — PHP 300.00
    • E-3 — PHP 260.00
    • E-2 — PHP 220.00
    • E-1 — PHP 200.00
  • Section 17 directs that family subsistence allowance advance or payment is computed based on the enlisted man’s grade at the time of departure.
  • Section 17 provides a no-reimbursement protection where a cash advance already made to an enlisted man of the 10th or 20th BCT exceeds the family subsistence allowance prescribed; the enlisted man shall not be required to reimburse the difference.

  • Section 19 provides that any trainee who serves with the colors longer than 10 months, except those required by regulations to serve additional periods due to misconduct or unauthorized absences during normal trainee instruction, receives pay and allowances at the same rates prescribed for enlisted men of the Regular Force.

Authorized force levels and emergency adjustments

  • Section 20 provides that the total number of enlisted men authorized in each grade is as the President may direct.
  • Section 20 provides that, in case of national emergency, the President may prescribe new rates of pay and allowances of enlisted men and trainees of the AFP that are not less than the rates prescribed in the Act.
