Role, Election, and Compensation of the Vice-Mayor
- The Vice-Mayor performs duties of the Mayor in cases of sickness, absence, temporary incapacity, or definitive vacancy until the position is lawfully filled.
- If the Vice-Mayor is incapacitated or the position vacant, the City Engineer exercises the Mayor’s duties.
- The acting Mayor has the same powers and responsibilities as the Mayor.
- The Vice-Mayor is an ex-officio member of the Municipal Board.
- Additional duties may be assigned by the Mayor or prescribed by law or ordinance.
- The Vice-Mayor is elected by the same electorate and must meet the same qualifications as the Mayor.
- The Vice-Mayor’s salary is fixed at 3,600 pesos per annum.
Composition and Function of the Municipal Board
- The Municipal Board is the legislative body of the city.
- It is composed of the Mayor (presiding officer), Vice-Mayor, and five councilors elected at large.
- Temporary substitution of members by Presidential appointment is allowed during sickness, absence, suspension, or to maintain quorum.
- Members are disqualified from participating in election-related duties if they are candidates in that election.
- Other members may choose a disinterested elector to assist in such election matters.
- Members receive per diem compensation as provided by Republic Act No. 840.
Qualifications, Election, Suspension, and Removal of Board Members
- Members must be qualified electors and residents of the city for at least one year.
- Minimum age qualification is 23 years.
- Election occurs during the general elections for provincial and municipal officials.
- Term of office is four years; members assume office per the Revised Election Code.
- Suspension or removal is under the same conditions and procedures as elective provincial officials.
Implementation of the Law
- The first election of Mayor, Vice-Mayor, and councilors under this Act occurs at the next general election following the Act's approval.
- The law takes effect immediately upon approval.
