Legal basis and constitutional framework
- The IRR is issued pursuant to Section 4 of Republic Act No. 11621, which authorizes implementation rules.
- The IRR aligns with the State mandate under Article XIV of the 1987 Constitution.
- The IRR is designed to be consistent with the governance framework of Republic Act No. 9155 (Governance of Basic Education Act of 2001).
- The IRR is designed to be compliant with the program structure and standards of Republic Act No. 10533 (Enhanced Basic Education Act of 2013).
- The IRR is also made consistent with subsequent education-related laws enacted thereafter.
Policy rationale and purpose
- The IRR primarily applies to the administration, organization, and procedures for the operation of Dupag National High School (DNHS).
- The operation of DNHS is meant to achieve the purpose of offering a complete secondary education program.
- DepEd is vested with authority, accountability, and responsibility to achieve higher learning outcomes under the governance framework for basic education.
Separation, conversion, and absorption
- The Naneng National High School - Mosimos Extension in Barangay Dupag, City of Tabuk, Province of Kalinga is separated from Naneng National High School.
- The separated extension is converted into an independent national high school known as Dupag National High School (DNHS).
- All personnel, assets, liabilities, and records of the Naneng National High School - Mosimos Extension are transferred to and absorbed by DNHS.
Definitions and statutory terms
- “Act” refers to Republic Act No. 11621.
- “Learning Facilitator” has the meaning in Section 3(i) of Republic Act No. 9155, as the key-learning support person responsible for supervising/facilitating the learning process and activities of learners.
- “Learning Support Aide (LSA)” has the meaning in Department Order (DO) No. 32, s. 2020, as a person who collaborates with a teacher and contributes to the provision of learning opportunities promoting achievement and progression of learners.
- “Non-Teaching Personnel” has the meaning in Section 1.4(q) of the IRR of RA 9155, as an employee not actually involved in classroom teaching but who indirectly and indispensably assists in delivering services to educational constituencies and clientele.
- The IRR provides non-teaching personnel examples, including Administrative Officer, Accountant, Personnel Officer, Supply Officer, Records Officer, and other support staff at central, regional, division, and school levels.
- “RA 9155” refers to “AN ACT INSTITUTING A FRAMEWORK OF GOVERNANCE FOR BASIC EDUCATION, ESTABLISHING AUTHORITY AND ACCOUNTABILITY, RENAMING THE DEPARTMENT OF EDUCATION, CULTURE AND SPORTS AS THE DEPARTMENT OF EDUCATION, AND FOR OTHER PURPOSES”.
- “RA 10533” refers to “AN ACT ENHANCING THE PHILIPPINE BASIC EDUCATION SYSTEM BY STRENGTHENING ITS CURRICULUM AND INCREASING THE NUMBER OF YEARS FOR BASIC EDUCATION, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES”.
- “RA 11713” refers to “AN ACT FURTHER STRENGTHENING TEACHER EDUCATION IN THE PHILIPPINES BY ENHANCING THE TEACHER EDUCATION COUNCIL, ESTABLISHING A SCHOLARSHIP PROGRAM FOR STUDENTS IN THE TEACHER EDUCATION PROGRAM, INSTITUTIONALIZING THE NATIONAL EDUCATORS ACADEMY OF THE PHILIPPINES, AND APPROPRIATING FUNDS THEREFOR, AMENDING FOR THE PURPOSE REPUBLIC ACT NO. 7784, ENTITLED ‘AN ACT TO STRENGTHEN TEACHER EDUCATION IN THE PHILIPPINES BY ESTABLISHING CENTERS OF EXCELLENCE, CREATING A TEACHER EDUCATION COUNCIL FOR THE PURPOSE, APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES’ otherwise known as the ‘Excellence in Teacher Education Act.’”
- “School-Based Management (SBM)” has the meaning in DepEd Order (DO) 45, s. 2015, as decentralization of decision-making from central, regional, and division levels to individual schools to improve learning outcomes through effective schools involving school heads, teachers, students, parents, local government units, and the community.
- “Teacher/Teaching Personnel” has the meaning in Section 3(k) of RA 11713, as qualified persons engaged in teaching at basic education level in public or private institutions, including teachers who may not be employed strictly as such.
- For purposes of the IRR, “teacher” may also refer to “teaching personnel.”
DepEd systems, curriculum, and school operations
- DepEd must immediately include DNHS in its program of expenditures and must ensure basic education inputs for DNHS’s operations that are compliant with minimum service standards and appropriate to the needs of learners and teachers.
- Basic education inputs include adequate instructional rooms such as academic classrooms, computer room, science laboratory and workshop room, and ancillary facilities such as multi-purpose rooms, library, and clinic.
- Basic education inputs include instructional materials, tools, equipment, furniture, and water and sanitation facilities required for delivering public secondary education services.
- DepEd must include DNHS in the Enhanced Basic Education Information System (EBEIS), the Learner Information System (LIS), and other DepEd management information systems.
- DNHS must implement the basic education curriculum formulated and designed by DepEd in accordance with the standards and principles under Section 10, Rule II of the IRR of RA 10533, and other pertinent DepEd issuances.
School head authority and responsibilities
- The school head of DNHS must be appointed and compensated in accordance with RA 9155, Civil Service laws, and other applicable laws, rules, regulations, and guidelines.
- The school head must serve as both an instructional leader and an administrative manager.
- The school head must form a team with school teachers/learning facilitators for delivery of quality educational programs, projects, and services.
- The school head must lead a core of non-teaching staff for the school’s administrative, fiscal, and auxiliary services.
- The school head must have authority, accountability, and responsibility to:
- Set the school’s mission, vision, goals and objectives;
- Create an environment conducive to teaching and learning;
- Implement the school curriculum and be accountable for higher learning outcomes;
- Develop the school education program and school improvement plan;
- Offer educational programs, projects, and services providing equitable opportunities for all learners in the community;
- Introduce new and innovative modes of instruction to achieve higher learning outcomes;
- Administer and manage all school personnel, physical and fiscal resources;
- Recommend the school’s staffing complement based on needs;
- Encourage staff development;
- Establish school and community networks and encourage active participation of teachers organizations, non-academic personnel of public schools, and parent-teachers community associations;
- Accept donations, gifts, bequests, and grants for upgrading teachers’/learning facilitators’ competencies, improving/expanding school facilities, and providing instructional materials and equipment, with such donations/grants required to be reported to the appropriate district supervisors and division superintendents; and
- Perform other functions assigned by proper authorities.
Staffing creation and recruitment
- DepEd must create the items and recruit/deploy the necessary teaching and non-teaching personnel in DNHS.
- Recruitment and deployment must be consistent with existing DepEd guidelines and standards on the authorized manpower and staffing complement of public schools and/or establishment of organizational structures for small, medium, large, and extra-large public schools.
- Recruitment and deployment must include consistency with DepEd guidelines on the hiring of teachers and LSAs.
- The team of teaching and non-teaching personnel must also be consistent with guidelines and standards of the Department of Budget and Management (DBM), the Civil Service Commission (CSC), and other relevant government agencies.
Monitoring and performance reporting
- DNHS must endeavor to produce high learning outcomes consistent with SBM and other systems for operationalization of public basic education schools.
- DNHS’s performance must be closely monitored and reported by the concerned DepEd division and regional offices.
Appropriations, amendments, and repeals
- The Secretary of Education must immediately include in the Department’s program the operationalization of DNHS.
- The initial funding must be charged against the current year's appropriation of the Naneng National High School - Mosimos Extension.
- Continued operation funding must be included in the annual General Appropriations Act thereafter.
- Amendments to the IRR must be promulgated by the Secretary of DepEd, and to the extent applicable, in consultation with DNHS.
- All DepEd Orders and other related issuances, rules, and regulations inconsistent with the IRR are repealed, rescinded, or modified accordingly.
Separability and operational effect
- If any clause, sentence, paragraph, or part of the IRR is declared unconstitutional, the remaining provisions remain in full force and effect.
