OTS powers and operational responsibilities
- The OTS shall assume the functions of the National Civil Aviation Security Committee (NCASC) listed in Section 4 of Executive Order No. 277 dated January 30, 2004, together with all other NCASC powers and functions, subject to Section 3.
- The OTS shall exercise operational control and supervision over all units of law enforcement agencies and agency personnel providing security services in transportation systems, except for motor vehicles in land transportation, jointly with the heads of the bureaus or agencies to which such units or personnel belong or are assigned.
- The OTS shall be responsible for transportation security operations, including:
- Security screening of passengers, baggage and cargoes; and
- Hiring, retention, training and testing of security screening personnel.
- The OTS shall formulate, develop, promulgate, and implement comprehensive security plans, policies, measures, strategies, and programs to address threats to transportation security, and shall continually review, assess, and upgrade them to improve and ensure adequacy.
- The OTS shall examine and audit performance of transportation security personnel, equipment, and facilities, and shall establish continuing performance standards, including standards for training.
- The OTS shall prepare a security manual/master plan or programme prescribing rules for efficient and safe operation of transportation systems, including:
- Standards for security screening procedures;
- Prior screening or profiling of individuals for issuance of security access passes; and
- Determination of levels of security clearances for personnel of the OTS, the DOTC and its attached agencies, and other government agencies.
- The OTS shall prescribe security and safety standards for all transportation systems consistent with existing laws, rules, regulations, and international conventions.
- The OTS shall, subject to approval of the Secretary of the DOTC, issue Transportation Security Regulations/Rules, and shall amend, rescind, or revise them as necessary.
- The OTS may enlist assistance of any department, bureau, office, instrumentality, or government-owned or controlled corporation, including use of their personnel, facilities, and resources.
- The OTS shall coordinate with law enforcement agencies for investigation and prosecution of illegal acts or unlawful interference committed at or directed to any public transportation system.
- The OTS shall perform other functions necessary to carry out the Executive Order or as directed by the Secretary of the DOTC.
NCASC advisory forum reconstituted under DOTC
- The NCASC shall act as an advisory body and consultative forum for the Secretary of the DOTC on matters relating to civil aviation security.
- The NCASC is transferred from the Department of the Interior and Local Government (DILG) to the DOTC.
- The NCASC is reconstituted with the following membership:

- The OTS shall continue to serve as the Secretariat of the NCASC.
- Qualified DILG personnel performing secretariat functions for the NCASC shall have the option to transfer to the DOTC and be absorbed by the OTS.
DOTC security committees for other modes
- The Secretary of the DOTC may create other security committees composed of concerned government agencies and stakeholders.
- These security committees shall assist in the formulation, development, and implementation of:
- National security programmes for sea transport and maritime infrastructure; and
- National security programmes for land transportation, rail system and infrastructure.
Funding and appropriation arrangement for OTS
- The amount necessary for the initial operation and administration of the OTS shall be chargeable against funds for the purpose and other sources recommended by the Department of Budget and Management.
- After initial operation, appropriations for the OTS shall be included in the budget proposals under the DOTC.
Implementing rules within 90 days
- Within ninety (90) days from the effectivity of the Executive Order, the OTS shall promulgate rules and regulations necessary for implementation.
- The OTS rules and regulations must be promulgated subject to the approval of the Secretary of the DOTC.
Modifications, repeal, and effectivity
- Executive Order No. 277 dated January 30, 2004 is modified accordingly.
- All other orders, rules, regulations, issuances, or parts thereof inconsistent with the Executive Order are repealed or modified accordingly.
- The Executive Order takes effect immediately.
Authority, title, issuance date, and effectivity
- The issuance is Executive Order No. 311.
- It is titled “DESIGNATING THE OFFICE FOR TRANSPORTATION SECURITY AS THE SINGLE AUTHORITY RESPONSIBLE FOR THE SECURITY OF THE TRANSPORTATION SYSTEMS OF THE COUNTRY, EXPANDING ITS POWERS AND FUNCTIONS AND FOR OTHER PURPOSES.”
- It is dated April 26, 2004 and signed in City of Manila on April 26, 2004.
- It takes effect immediately.
