Purpose and declared policy
- The Executive Order is grounded on the need to expand the Port Zone of San Jose (Occidental Mindoro) to accommodate projected increases in port traffic.
- It mandates port expansion to support the demands of the shipping trade within the region.
- Section 2 requires the Philippine Ports Authority to implement the port zone’s zoning, planning, development, and utilization in a manner consistent with regional industrial plans of the Government.
Port zone territorial jurisdiction delineation
- Section 1 delineates the territorial jurisdiction of the Port of San Jose (Occidental Mindoro) by describing boundary points on a plan.
- The delineation begins at point 1, then proceeds in sequence to points 2, 3, 4, 5, and returns to point 1.
- The boundary description uses specified distances and bearings:
- From point 1 to point 2: 303.00 m with bearing S 66A 30' E
- From point 2 to point 3: 652.00 m with bearing N 24A 30' E
- From point 3 to point 4: 612.45 m with bearing N 65A 40' W
- From point 4 to point 5: 685.00 m with bearing S 24A 30' W
- From point 5 back to point 1: the distance is 310.00 m with bearing S 70A 57' E
- The total area covered is 405,467.91 sq. m. more or less.
Administrative jurisdiction under PPA
- Section 2 places the San Jose (Occidental Mindoro) Port Zone, as delineated in Section 1, under the administrative jurisdiction of the Philippine Ports Authority.
- The Philippine Ports Authority must implement a program for proper zoning of the port zone.
- The Philippine Ports Authority must implement a program for planning the port zone.
- The Philippine Ports Authority must implement a program for development and utilization of the port zone.
- The port zoning, planning, development, and utilization must be done consistent with the regional industrial plans of the Government.
Repeal or modification of inconsistent issuances
- Section 3 repeals or modifies all other orders, proclamations, and issuances, or portions thereof, that are inconsistent with the Executive Order.
- The repeal or modification is limited to provisions that conflict with Executive Order No. 416.
