Housing Need and Program Launch

- To address this demand, the Pambansang Pabahay Para sa Pilipino (4PH) Program was launched to stimulate housing development and support economic growth.

Declaration and Leadership of 4PH Program
- The 4PH Program is declared a flagship government program.
- DHSUD is designated as the lead implementing agency for housing and human settlements management nationwide.
- All NGAs, LGUs, and government entities are mandated to fully support and cooperate with DHSUD in program implementation.
Identification and Development of Lands for Housing
- DHSUD tasked to identify suitable lands owned by national and local governments for housing, including new townships and estates.
- Coordination with concerned NGAs and LGUs is required for land identification and development.
- DHSUD can recommend to the President, through the DENR, issuance of Proclamations to declare public lands alienable and disposable specifically for housing and human settlements, subject to applicable laws.
Mandatory Land Inventory Submission
- NGAs, agencies, instrumentalities, including GOCCs and subsidiaries, plus LGUs must inventory lands they own or administer.
- Inventories must be submitted to DHSUD within 60 calendar days of the order’s issuance.
- Focus on idle lands or lands unused for at least 10 years without improvements, per specific legal provisions.
- Land Registration Authority (LRA) will assist agencies by providing title lists and certified copies.
Acquisition, Titling, and Development Process
- DHSUD authorized to acquire ownership or administration of identified lands for housing purposes, subject to existing laws.
- LRA to cancel previous titles and re-issue titles under DHSUD’s name according to the Property Registration Decree.
- Immediate development of these lands is mandated once acquired.
Expropriation Powers
- DHSUD, either directly or through KSAs, may exercise eminent domain to expropriate lands necessary for housing projects.
- All actions under this provision must comply with existing laws, rules, and regulations.
Agency Cooperation and Support
- All concerned NGAs, instrumentalities, GOCCs, and partner LGUs are required to provide assistance and support to DHSUD to facilitate effective program implementation.
Reporting and Monitoring
- NGAs, instrumentalities, GOCCs are directed; LGUs are enjoined to submit regular implementation reports to DHSUD.
- DHSUD tasked to consolidate reports and submit summaries to the President via the Office of the Executive Secretary.
Staffing and Organizational Changes
- DHSUD will assess and propose additional positions and organizational adjustments necessary for program administration.
- Proposed changes require review and approval from the Department of Budget and Management complying with relevant laws and regulations.
Rulemaking and Regulation Formulation
- DHSUD must formulate implementing rules and regulations within 30 working days from the effectivity of this Order to ensure proper execution.
Funding Provisions
- Initial funding will be taken from current appropriations of concerned agencies.
- Subsequent funding will be included in the annual General Appropriations Act following standard budget processes.
Legal Provisions on Validity and Repeal
- Separability clause ensures that invalid provisions will not affect the validity of the remainder of the Order.
- Conflicting orders, rules, regulations, or parts thereof are repealed or modified.
Effectivity
- The Order takes effect upon publication in the Official Gazette or a newspaper of general circulation.
