Creation and abolition of intelligence agencies
- Section 1 creates the National Intelligence Coordinating Agency, referred to as NICA, under the Office of the President.
- Section 1 provides that NICA replaces the National Intelligence and Security Authority (NISA) and the Civil Intelligence and Security Agency (CISA).

NICA’s role in intelligence coordination
- Section 2 makes NICA the focal point for the direction, coordination, and integration of government activities involving national intelligence.
- Section 2 requires NICA to separate intelligence estimates of local and foreign situations for the formulation of national policies by the President.
Leadership, succession, and appointment
- Section 3 provides that NICA is headed by a Director-General assisted by a Deputy Director-General.
- Section 3 requires that both the Director-General and Deputy Director-General are appointed by the President.
- Section 3 provides that both officials hold office at the pleasure of the President.
- Section 4 directs that the Deputy Director-General assists the Director-General and, in the absence of the Director-General, performs the Director-General’s functions.
Relationship with the National Security Council
- Section 5 places NICA under the administrative supervision of the National Security Council.
- Section 5 provides that the National Security Council gives support services to NICA.
- Section 5 allows NICA to report directly to the President as the President may require.
National Intelligence Board as advisory body
- Section 6 provides that the National Intelligence Board (NIB) continues to serve as the advisory body to the Director-General of NICA.
- Section 6 requires the NIB to support coordination and integration of intelligence activities in the Government.
- Section 7 provides that members of the NIB are appointed by the President.
- Section 7 provides that the National Security Director may sit in all meetings of the Board.
Internal organizational structure of NICA
- Section 8 provides that the organization of NICA consists of the following components:
- Section 8(a) creates the Office of the Director-General, which manages and operates the agency components and provides executive staff support, public relations, legal service, and internal audit.
- Section 8(b) creates the Directorate for Operations, headed by the Assistant Director-General for Operations, responsible for the collection of information.
- Section 8(c) creates the Directorate for Production, headed by the Assistant Director-General for Production, responsible for preparing intelligence estimates and other reports, and maintaining automated data processing for the agency.
- Section 8(d) creates the Directorate for Administration, headed by the Assistant Director-General for Administration, responsible for personnel and training, transportation and communications, supplies and materials, grounds and buildings maintenance, security, and other support services.
- Section 8(e) creates the Management and Planning Office, which formulates plans, policies, and programs on the direction, integration, and coordination of national intelligence activities and on operation and management improvement of the agency.
- Section 8(f) creates the Office of the Comptroller, which provides financial management and control for the agency.
- Section 8(g) authorizes as many Field Stations as may be determined by the Director-General, to undertake intelligence collection activities and provide reports for assessments and estimates.
Staffing pattern, transfers of assets, and funding
- Section 9 provides that the organization and staffing pattern of NICA is recommended by the Director-General for approval of the President.
- Section 10 requires the transfer to appropriate offices and divisions of NICA of:
- all funds, records, equipment, buildings, facilities, and other properties of NISA and CISA, and
- such personnel as may be necessary based on qualifications and merit, as determined by the Director-General of NICA.
- Section 10 requires that after transfers, sums necessary to carry out the Executive Order shall be included annually in the General Appropriations Act.
Benefits for terminated personnel
- Section 11 provides that personnel whose services are terminated due to the abolition or reorganization of NISA and CISA receive retirement benefits they may be entitled to under existing laws, rules, and regulations.
- Section 11 provides that otherwise, terminated personnel receive the equivalent of one-month basic salary for every year of service or the equivalent nearest fraction thereof, computed on the basis of the highest salary received.
- Section 11 imposes a cap: the payment shall not exceed the equivalent of twelve (12) months salary.
Repeal, separability, and immediate effect
- Section 12 repeals or modifies inconsistent laws, presidential decrees, executive orders, letters of instructions, and edicts.
- Section 13 provides that if any provision of the Executive Order is found invalid or unconstitutional, the remaining provisions continue in full force and effect.
- Section 14 provides that the Executive Order takes effect immediately.
