Executive Order No. 246 establishes the National Intelligence Coordinating Agency (NICA) in the Philippines to integrate national intelligence and ensure government stability, replacing the abolished National Intelligence Security Authority (NISA) and Civil Intelligence and Security Agency (CISA).

Primary Functions and Role of NICA

  • Serves as the central agency for the direction, coordination, and integration of national intelligence activities.
  • Responsible for separating intelligence estimates relating to local and foreign situations to aid presidential national policy formulation.

Leadership and Appointment

  • Headed by a Director-General and assisted by a Deputy Director-General.
  • Both officials are appointed by the President and serve at the President's pleasure.
  • Deputy Director-General performs duties of the Director-General in the latter’s absence.

Administrative Supervision and Reporting

  • NICA is under the administrative supervision of the National Security Council (NSC).
  • Provides support services to the NSC but may report directly to the President as required.

Advisory Body: National Intelligence Board (NIB)

  • Continues to operate as the advisory body to NICA’s Director-General.
  • Members appointed by the President.
  • National Security Director may attend all NIB meetings.

Organizational Structure of NICA

  • Office of the Director-General: Oversees management, operations, executive support, public relations, legal services, and internal audit.
  • Directorate for Operations: Leads information collection, headed by Assistant Director-General for Operations.
  • Directorate for Production: Manages intelligence estimates, reports, and automated data processing, led by Assistant Director-General for Production.
  • Directorate for Administration: Handles personnel, training, transport, communications, supplies, security, and other support services.
  • Management and Planning Office: Develops plans, policies, and programs related to national intelligence and Agency improvements.
  • Office of the Comptroller: Responsible for financial management and control.
  • Field Stations: Conduct intelligence collection and provide reports as directed.

Staffing and Organizational Approval

  • NICA’s organization and staffing patterns are recommended by the Director-General for presidential approval.

Transfer of Assets and Personnel

  • Transfers all funds, records, equipment, properties, and qualified personnel from NISA and CISA to NICA.
  • Annual budgetary provisions to include necessary sums for NICA’s operations.

Personnel Separation and Retirement Benefits

  • Personnel terminated due to abolition or reorganization receive retirement benefits under existing laws.
  • If not entitled to retirement, personnel receive separation pay equivalent to one month’s salary per year of service, capped at twelve months salary.

Repeal and Modification of Conflicting Laws

  • Repeals or modifies any inconsistent laws, executive orders, or issuances with this order.

Severability Clause

  • Declares that invalidity or unconstitutionality of any provision will not affect the validity of remaining provisions.

Effectivity

  • The Executive Order takes immediate effect upon issuance on July 24, 1987.
