NICA is created under the Office of the President. It replaces the National Intelligence and Security Authority (NISA) and the Civil Intelligence and Security Agency (CISA), which were abolished.
To establish and maintain a mechanism under the Office of the President to integrate national intelligence and ensure stability of government.
It is the focal point for the direction, coordination, and integration of government activities involving national intelligence, and it separates intelligence estimates of local and foreign situations for the formulation of national policies by the President.
NICA is headed by a Director-General assisted by a Deputy Director-General. Both are appointed by the President and hold office at the pleasure of the President.
The Deputy Director-General assists the Director-General and, in the absence of the Director-General, performs the functions of the Director-General.
NICA is under the administrative supervision of the National Security Council, which provides support services. However, the agency may report directly to the President as the President may require.
The NIB continues to serve as the advisory body to the Director-General of NICA for the coordination and integration of intelligence activities in the Government.
The members of the NIB are appointed by the President. The National Security Director may sit in all meetings of the Board.
They include: (a) Office of the Director-General (management/operation, executive staff support, public relations, legal service, internal audit); (b) Directorate for Operations (collection of information); (c) Directorate for Production (intelligence estimates and reports; automated data processing); (d) Directorate for Administration (personnel/training, transportation/communications, supplies/materials, maintenance, security, support); (e) Management and Planning Office (plans/policies/programs for direction/integration/coordination and operational improvement); (f) Office of the Comptroller (financial management and control); and (g) Field Stations (intelligence collection and reporting for assessments/estimates).
As many Field Stations as may be determined by the Director-General.
The Director-General recommends the organization and staffing pattern for approval by the President.
All funds, records, equipment, buildings, facilities, properties, and such personnel as may be necessary—based on qualifications and merit as determined by the Director-General of NICA—are transferred to appropriate offices and divisions of NICA. Thereafter, necessary sums are included annually in the General Appropriations Act.
They receive retirement benefits under existing laws, rules, and regulations if entitled. Otherwise, they are paid an amount equivalent to one-month basic salary for every year of service (or nearest fraction), based on the highest salary received, but not exceeding the equivalent of twelve (12) months salary.
All laws, presidential decrees, executive orders, letters of instructions, and edicts inconsistent with EO 246 are repealed or modified accordingly.
It takes effect immediately.
No. Under Section 13, the invalidity or unconstitutionality of any provision does not affect other provisions, which continue in full force and effect.
