Created municipality and barangay separation
- Section 1 separates Barangays Burgos, Iba, Labney, Lawacamulag, David, Lubigan, Maamot, Mababanaba, Moriones, Pao, San Juan de Valdez, Sula, and Villa Aglipay from the Municipality of Tarlac, Province of Tarlac.
- The separated barangays are constituted into a distinct and independent municipality known as the Municipality of San Jose, Tarlac.
- The seat of government of the new municipality is at the present site of Barangay Villa Aglipay.
Geographic boundaries of San Jose
- Section 2 defines the Municipality of San Jose boundaries as follows:
- East: Barangays Sto. Domingo, Sapang Maragul, Tibag, and Armenia of the Municipality of Tarlac.
- West: the Province of Zambales.
- South: the Municipality of Capas.
- North: the Municipalities of Sta. Ignacia and Mayantoc.
When the municipality begins to exist
- Section 3 provides that the Municipality of San Jose begins to exist upon ratification by a majority of votes cast in a plebiscite.
- The plebiscite must be conducted within one hundred twenty (120) days after the approval of this Act.
- The Commission on Elections conducts and supervises the plebiscite (Section 3).
- The expenses for the plebiscite are taken from the Contingent Fund under the current fiscal year appropriations (Section 3).
Initial local officials and term
- Section 4 provides that the first mayor, vice-mayor, and councilors of the new municipality are appointed by the President.
- The initial officials serve until noon of June 30, 1992 (Section 4).
Turnover of local revenues
- Section 5 directs that upon approval of the Act, the municipal treasurer of Tarlac, Tarlac must turn over to the municipal treasurer of the Municipality of San Jose, Tarlac:
- real estate taxes, and
- other fees collected
- from the barangays enumerated in Section 1.
Legislative enactment and approval
- The Act is enacted by the Senate and House of Representatives of the Philippines in Congress assembled.
- President Corazon C. Aquino approved Republic Act No. 6842 on January 5, 1990.
