Seat of Government
- The seat of government of the Municipality of San Jose is established in Barangay San Jose Proper.
Ratification and Appointment of Officials
- The creation of the Municipality of San Jose requires ratification by a majority of votes in a plebiscite conducted within the entire Municipality of Dinagat.
- The plebiscite must be held within 60 days from the approval of the Act.
- Upon ratification, the President shall appoint the officials of the new municipality.
- Appointed officials shall hold office until their duly elected successors have qualified.
Plebiscite Conduct and Funding
- The Commission on Elections (COMELEC) is mandated to conduct and supervise the plebiscite.
- Expenses for the plebiscite shall be drawn from the Contingent Fund under the current fiscal year appropriations.
Transfer of Assets, Obligations, and Properties
- After creation, the Municipality of San Jose will receive its proportionate share of the obligations, funds, assets, and other property of the Municipality of Dinagat.
- The transfer shall be based on the recommendation of the Commission on Audit.
Application of Existing Laws
- All existing laws governing municipal operations are made applicable to the Municipality of San Jose.
Repeal and Modification of Inconsistent Laws
- Any laws, decrees, executive orders, or regulations inconsistent with this Act are repealed or modified accordingly.
Effectivity
- The Act shall take effect upon publication in at least two national newspapers of general circulation.
