Policy purpose for local creation
- The decree states that the primary goal of the State is to accelerate progress across the land, including areas where political reasons impede the aims of the New Society.
- The decree directs that development and rehabilitation in Tawi-Tawi are best achieved by creating local government units for faster administrative response to social, cultural, and economic needs.
- The decree links the creation of the municipality to the maintenance of peace and order and the pacification drive to restore normalcy in the area.
Creation of Municipality of LaAguyan
- Section 1 detaches and separates specific barangays from the municipalities of Bongao, Tandubas, and South Ubian in Tawi-Tawi.
- The detached barangays are: Barangays LaAguyan Proper, Darussalam, Maraning, Tohog-Tohog, Parang Pantay, Bas Nunuk, Si Malak, Bakong, Tumbaga-an, Bas-bas and Tumahubong.
- The detached barangays constitute a separate and independent municipality to be known as the Municipality of LaAguyan.
- Section 1 provides that the creation does not affect the legal existence of Bongao, Tandubas, and South Ubian.
Government seat and local governance applicability
- Section 2 sets the seat of government of the newly created municipality in Barangay LaAguyan Proper.
- Section 3 applies all provisions of law applicable to regular municipalities to the new municipality of LaAguyan, except as otherwise provided in the decree.
Continuity of municipal officials and organization
- Section 4 provides that the present elective officials of the municipality of Bongao shall perform their duties in the newly created municipality until the officials of LaAguyan are duly appointed by the President.
- Section 4 states that the appointed officials shall hold office until their successors shall have been elected in the election for provincial and municipal officials following the issuance of the decree.
- Section 4 provides that the appointed officials hold office until they have qualified, unless sooner removed at the pleasure of the President.
- Section 4 authorizes appointment of necessary appointive officers and employees to complete organization of the government of LaAguyan in accordance with existing laws.
Allocation of assets, funds, and obligations
- Section 5 requires that, upon effectivity, the proportionate share of LaAguyan in the obligations, funds, assets, and other property of Bongao, Tandubas, and South Ubian shall be transferred.
- Section 5 provides that the transfer is to be done by the President upon the recommendation of the Commission on Audit.
Repeals and modifications
- Section 6 repeals or modifies all laws or parts of laws and all executive orders or regulations that are inconsistent with the decree.
- Section 6 declares that inconsistent provisions are repealed or modified accordingly.
