Questions (PRESIDENTIAL DECREE NO. 1086)

Presidential Decree No. 1086 (a presidential issuance “as part of the law of the land”) creates the Municipality of LaAguyan in the Province of Tawi-Tawi by detaching specified barangays from existing municipalities to form a new local government unit.

Barangays LaAguyan Proper, Darussalam, Maraning, Tohog-Tohog, Parang Pantay, Bas Nunuk, Si malak, Bakong, Tumbaga-an, Bas-bas, and Tumahubong—located in the municipalities of Bongao, Tandubas, and South Ubian—are detached to constitute the new Municipality of LaAguyan.

No. Section 1 expressly states that it does not affect the legal existence of the municipalities of Bongao, Tandubas, and South Ubian.

In Barangay LaAguyan Proper.

Except as otherwise provided in the decree, all provisions of law applicable to regular municipalities shall also apply to the new Municipality of LaAguyan.

They perform their duties as such in the newly created municipality until the President appoints the officials of the latter, who hold office until successors are elected in the next election for provincial and municipal officials and who have duly qualified.

Necessary appointive officers and employees to organize/complete the government personnel of LaAguyan shall be appointed as provided under existing laws; their tenure is governed by the decree’s framework that appointed officials hold office until their successors are elected and have qualified, unless sooner removed at the pleasure of the President.

Yes. They may be removed at the pleasure of the President unless sooner removed; otherwise they continue until the officials are duly appointed by the President and successors are elected in the next election.

The proportionate share of the new municipality in the obligations, funds, assets, and other property of Bongao, Tandubas, and South Ubian shall be transferred by the President to LaAguyan upon the recommendation of the Commission on Audit.

It recommends to the President the transfer of the proportionate share of the new municipality regarding obligations, funds, assets, and other property.

All laws or parts of laws, and all executive orders or regulations inconsistent with the decree are repealed or modified accordingly.

It takes effect immediately.

To accelerate progress and development in lagging or impeded areas, to better provide administrative response for social, cultural, and economic needs in Tawi-Tawi, and to support peace and order/pacification by restoring normalcy.

It means the new municipality has its own governmental identity and administration (separate political unit) while the original municipalities remain legally existing; however, resources and proportionate shares are reallocated as provided by Section 5.
