Provincial Capitals

  • The capital of Oriental Misamis is fixed as Cagayan.
  • The capital of Occidental Misamis is to be determined by a convention of municipal presidents and council members of Occidental Misamis municipalities, convened by the provincial governor within ten days after the province's constitution.

Applicability of Laws

  • All laws applicable to regular provinces apply equally to both Oriental Misamis and Occidental Misamis.

Governance of Oriental Misamis

  • The last elected provincial officers of the undivided Misamis Province continue governing Oriental Misamis until successors are elected and qualified.
  • Salaries of the provincial governor, treasurer, and fiscal of Oriental Misamis remain as previously set until legally readjusted.

Governance of Occidental Misamis

  • Upon implementation, elective provincial officers of Occidental Misamis are appointed by the Governor-General with Senate consent.
  • These appointees hold office until new elections and qualifications.
  • Compensation for the governor and other appointees follows Act No. 2829 rules.
  • Provincial board members receive a per diem not exceeding 15 pesos per day of actual session attendance.

Legislative Representation

  • Both provinces shall have one Representative each.
  • The current Representative of the First District of Misamis becomes the Representative of Oriental Misamis.
  • The current Representative of the Second District becomes the Representative of Occidental Misamis.

Distribution of Funds, Obligations, and Property

  • All financial resources, obligations, and properties are to be equitably distributed between Oriental and Occidental Misamis.
  • Distribution is based on recommendations from the Insular Auditor and approved by the Governor-General.

Repeal of Inconsistent Laws

  • Act No. 3354 and any laws inconsistent with this Act are repealed.

Effectivity

  • The Act takes effect on January 1, 1930.
