Creation of Sibagat Municipality in Agusan del Sur

Section 2 defines the boundaries of Sibagat by reference to named boundary lines, adjoining municipalities/cities, roads, bridges, and specified starting and ending points.
The boundary description begins at the intersection of the Cabadbaran–Old Bayugan and Surigao del Sur boundaries.
The boundary continues through specified directional movements and follows named boundary segments, including those involving Old Bayugan, Cabadbaran, Butuan City, Las Nieves, Esperanza, and Las Nieves, until it reaches the stated point of intersection.
The boundary includes a segment that connects the Sitio of Tag-libas at Barrio Ilihan to the point where it intersects the Agusan–Davao National Road at the middle of Wawa Bridge.
The boundary then proceeds on a defined course, including a 45 degrees northeast direction, and finally returns to the point of beginning at the intersection of Cabadbaran–Old Bayugan and Surigao del Sur boundaries.

Section 3 sets the seat of government of the newly created municipality in Barangay Sibagat.

Section 4 provides that, except as otherwise provided in the Act, all provisions of laws applicable to regular municipalities apply to the new Municipality of Sibagat.
Section 4 expressly covers the legal framework for Sibagat’s operation as a regular municipality, subject only to the Act’s own provisions.

Section 5 requires a plebiscite in the area or areas affected.
Section 5 provides that the plebiscite must be conducted within ninety (90) days after the approval of this Act.
Section 5 makes ratification dependent on the majority of the votes cast in the plebiscite.
After plebiscite ratification, Section 5 directs that the President (Prime Minister) shall appoint the mayor and other officials of Sibagat.

Section 6 requires the Commission on Elections to determine the sum needed for the conduct and supervision of the plebiscite under Section 5.
Section 6 directs that the determined amount shall be charged against the appropriation of the Commission on Elections for holding election/referendum/plebiscite in K.B.I. No. 1.1.3, Batas Pambansa Blg. 40.

Section 7 provides that, upon the effectivity of the Act, the proportionate share of Sibagat in the obligations, funds, assets, and other property of the Municipality of Bayugan must be transferred.
