Purpose, policy, and protected interests
- The Memorandum Circular is issued in order to protect the interest of the riding public and the legitimate grantees of Certificates of Public Convenience.
- The LTFRB creates the task force to ensure that only authorized units with valid and existing franchises operate as for hire vehicles.
- The LTFRB creates the task force to minimize “colorum” operations.
- The task force is also tasked with monitoring compliance with regard to standard fare rates.
Creation of anti-colorum and fare monitoring task force
- The LTFRB creates an “Anti-Colorum and Fare Monitoring Task Force.”
- The task force is composed of LTFRB personnel duly designated to act as head of the task force.
- The task force includes representatives from:
- Public Utility Buses Association
- Public Utility Jitneys Association
- Taxi Air-Conditioned Service Association
- School Transport Service Association
- Tourist Transport Service Association
- Truck for Hire Service Association
- The task force includes Accredited DOTC NGOs.
Apprehension, submission, and escalation of reports
- Apprehension for “colorum” operations and for non-compliance with the standard fare rates must be submitted to the head of the task force.
- The head of the task force must personally report the apprehension to the Office of the Chairperson for the latter’s appropriate action.
Representative restraint to prevent competitor controversies
- Members of the task force coming from their respective denomination/association are prohibited from apprehending vehicles.
- Members from a given association are prohibited from reporting violations pertaining to the denomination they are representing.
- The prohibition is enforced to avoid controversies between and among competitors in the transportation business.
Mandatory submission of association representatives
- All interested associations are required to submit a list of their representatives to the Office of the Chairperson.
Effect of the circular on existing issuances
- The Memorandum Circular supersedes any and all issuances inconsistent with it.
- The Memorandum Circular takes effect immediately.
