Legal basis for municipal creation
- Executive Order No. 283 is issued upon the recommendation of the Provincial Board of Zamboanga del Sur.
- The order is issued pursuant to section sixty-eight of the Revised Administrative Code.
Purpose and policy objective
- Executive Order No. 283 establishes an independent municipal government for the specific barrios and sitios segregated from the municipality of Molave, Zamboanga del Sur.
Segregated territory and organizing towns
- The order segregates the following barrios and sitios from Molave, Zamboanga del Sur: Lower Timonan, Colictop, Ecuan, Upper Timonan, Pogwan, Tungawan, Maralag, Bocayan, Dumingag, Doniao, Licama, Dapiwak, Guitran, Dilod, Yabu, Gonain, Manlabay, Marangan, Doray, Calomanggi, Palili, Guintananan, Baculon, Gumpingan, Bitian, Malaciawa, Ditolan, Dela, Gapasan, Tubay, Baquiran, Linay, Dipala, Batan, and Disered.
- The segregated territory is organized into the independent municipality of Dumingag in Zamboanga del Sur.
- The seat of government of the new municipality is set at the barrio of Dumingag.
Boundaries and territory adjustments
- The boundary between Dumingag and Molave is determined by the sketch map described in the order.
- The sketch map is described as the one for the remaining mother municipality of Molave and the proposed municipality of Dumingag.
- The sketch map is prepared and submitted by Assistant Civil Engineer Ernesto L. Renes of Zamboanga del Sur, and filed in this Office.
- After segregation, Molave retains its territory minus the portions included in Dumingag, as delimited in the order’s described boundary delineation.
Start of existence and financial-capability certification
- Dumingag begins to exist upon the appointment and qualification of the mayor, Vice-mayor, and a majority of the councilors.
- The order further requires certification by the Secretary of Finance that Dumingag is financially capable of implementing the Minimum Wage Law.
- The certification must also confirm that Dumingag can provide for all the statutory obligations and ordinary essential services of a regular municipality.
- The certification must also establish that the mother municipality of Molave, after segregation of the Dumingag territory, can still maintain creditably its municipal government and provide essential municipal services.
Promulgation and administrative execution
- The order is signed in the City of Manila on December 27, 1957.
- The order is executed under the authority of the President with countersignature by FORTUNATO DE LEON, Executive Secretary.
- The administrative mechanism for boundaries uses the filed sketch map prepared by Assistant Civil Engineer Ernesto L. Renes.
