Legal Basis and Authority
- The creation of the municipality is pursuant to the recommendation of the Provincial Board of Lanao del Norte.
- It is authorized under section 68 of the Revised Administrative Code.
Territorial Boundaries
- The municipal boundaries are defined with precision, based on natural landmarks and geographical markers:
- Starting from the mouth of the Linamon River on Iligan Bay.
- Extending westward along the seashore to the mouth of Larapan River.
- Following upstream the Larapan River to intersect a straight line between survey monuments M.B.M. Nos. 3 and 2.
- Proceeding eastward through M.B.M. Nos. 3 and 4 to the west bank of the Agus River.
- Following the Agus River downstream to its junction with Linamon River.
- Then following downstream the Linamon River to its mouth on Iligan Bay.
- The boundaries are based on a map prepared by the Highway District Engineer with a scale of 1:25,000.
- The territory of the municipality of Kauswagan is correspondingly reduced by the excluded areas now constituted as Linamon.
Conditions for Existence
- The municipality of Linamon shall commence formal existence only upon:
- Appointment and qualification of its local officials, including mayor, vice-mayor, and majority of councilors.
- Certification from the Secretary of Finance that the new municipality can financially sustain:
- Compliance with the Minimum Wage Law.
- Fulfillment of statutory obligations and provision of essential local services.
- Certification that the mother municipality, Kauswagan, remains financially capable and able to maintain its government and services despite the territorial loss.
Implementation Details
- The measure ensures balanced fiscal viability for both the new municipality and the mother municipality before formal establishment.
- The order was signed by the President of the Philippines and duly executed in Manila on January 13, 1960.
- The assistant executive secretary affirms the official enactment of this executive order.
