Operationalization and Appropriation of Funds

  • The Chief Justice of the Supreme Court, coordinating with the Secretary of the Department of Justice, is tasked to include in its program the operationalization of the newly created RTC branch, MTC, and MCTC in the second legislative district of Misamis Occidental.
  • Appropriation and release of funds depend on the actual organization of the courts and appointment of personnel.

Transfer and Jurisdiction of Pending Cases

  • All pending cases within the jurisdiction of Sinabacan and Tudela shall be transferred to the newly created Fourth MCTC.
  • Pending cases concerning Jimenez municipality shall be transferred to the Third MCTC.
  • The transferred cases shall be tried and decided by the court into which they are transferred.

Amendments to the Judiciary Reorganization Act of 1980

  • This Act amends Section 14(k) and Section 29 of Batas Pambansa Blg. 129 (Judiciary Reorganization Act of 1980).
  • Any inconsistent laws, decrees, orders, rules, regulations, or issuances are amended, repealed, or modified accordingly to conform with this Act.

Effectivity and Enforcement

  • The Act shall take effect fifteen (15) days after its publication in the Official Gazette or in newspapers of general circulation.
  • Signed and approved by the President, Senate President, and Speaker of the House of Representatives with relevant procedural history noted.
