Legal basis and election synchronization purpose
- Republic Act No. 10153 synchronizes elections in the Autonomous Region in Muslim Mindanao (ARMM) with national and local elections starting on the second (2nd) Monday of May 2013 and every three (3) years thereafter.
- Because of that synchronization, Officers-in-Charge (OICs) must perform the functions of ARMM elective offices until the officials duly elected in the May 2013 elections have qualified and assumed office.
- Section 4 of Republic Act No. 10153 mandates a screening committee to screen and recommend persons to be appointed as OICs for ARMM.
Screening committee composition and membership
- A Screening Committee is created pursuant to Section 4 of Republic Act No. 10153 (Section 1).
- The Screening Committee includes the following members (Section 1):
- Secretary, Department of the Interior and Local Government (DILG);
- Secretary, Department of National Defense (DND);
- Political Adviser, Office of the Political Adviser (OPA);
- One (1) Civil Society Representative, to be appointed by the President; and
- One (1) Representative, nominated from among and by the five (5) governors and one (1) city mayor of ARMM.
- The DILG Secretary must convene the Screening Committee immediately upon effectivity of the Executive Order (Section 2).
Committee organization and Secretariat support
- The DILG Secretary presides at the opening session until a Chairman is elected by the Committee (Section 2).
- The Secretariat is designated as the President’s Personnel Group Secretariat (PPGS) of the Presidential Management Staff (PMS) (Section 3).
- The Office of the Presidential Adviser on Peace Process (OPAPP) and the DILG provide assistance to the Secretariat as may be required (Section 3).
Screening, consultation, deadlines, and outputs
- The Screening Committee must submit its recommendations to the President within thirty (30) days from convening (Section 4).
- The submission must be made not later than ten (10) days before 30 September 2011 (Section 4).
- The Committee must submit the shortlist after due consultations with the Senate President and the Speaker of the House of Representatives (Section 4).
- The Committee must submit a shortlist of at least three (3) nominees to every vacancy in the elective positions in the ARMM Regional Government (Section 4).
OIC recommendation standards and qualification test
- No person shall be recommended as an OIC unless the person possesses the qualifications required by Republic Act No. 6734 and Republic Act No. 9054 (Section 5).
- In determining qualifications, the Committee must consider:
- educational preparation;
- experience;
- performance;
- accomplishments;
- reputation for honesty;
- integrity;
- incorruptibility;
- irreproachable conduct; and
- fidelity to sound moral and ethical standards (Section 5).
Internal rules and regulatory authority
- The Screening Committee must promulgate its own rules and regulations for the screening of applicants to carry out the Executive Order and applicable laws (Section 6).
Funding and administrative support
- The funding requirements of the Committee are provided by the Office of the President (Section 7).
Separability, repealing, and operative continuity
- If any provision of the Executive Order is declared invalid or unconstitutional, the other provisions not affected remain valid and subsisting (Section 8).
- All orders, rules, regulations, and issuances, or parts thereof, inconsistent with the Executive Order are repealed, amended, or modified accordingly (Section 9).
