Executive Order No. 51 is based on Section 4 of Republic Act (R.A.) No. 10153, which mandates the creation of a screening committee to screen and recommend persons to be appointed as Officers-in-Charge (OICs) for ARMM elective positions.

Because R.A. No. 10153 synchronized ARMM elections with national and local elections starting in May 2013 and every three (3) years thereafter, there was a need to appoint OICs to perform the functions of the Regional Governor, Regional Vice Governor, and Regional Legislative Assembly members until the officials elected in May 2013 qualify and assume office.

The screening committee is tasked to screen and recommend nominees for every vacancy in the elective positions in the ARMM Regional Government: (1) Office of the Regional Governor, (2) Office of the Regional Vice Governor, and (3) Members of the Regional Legislative Assembly.

The members are: (a) the Secretary of the Department of the Interior and Local Government (DILG); (b) the Secretary of the Department of National Defense (DND); (c) the Political Adviser, Office of the Political Adviser (OPA); (d) one (1) civil society representative appointed by the President; and (e) one (1) representative nominated from among the governors and one city mayor of ARMM.

The DILG Secretary shall convene the committee immediately upon effectivity and shall preside at the opening session until a Chairman is elected by the Committee.

The President’s Personnel Group Secretariat (PPGS) of the Presidential Management Staff (PMS) serves as the Secretariat.

The Office of the Presidential Adviser on Peace Process (OPAPP) and the DILG shall provide assistance to the Secretariat as may be required.

The committee must submit to the President, within thirty (30) days from convening but not later than ten (10) days before 30 September 2011, after due consultations with the Senate President and the Speaker of the House of Representatives.

For every vacancy, the committee must submit a shortlist of at least three (3) nominees.

The committee must conduct due consultations with the Senate President and the Speaker of the House of Representatives.

No person shall be recommended unless he/she possesses the qualifications required by R.A. No. 6734 and R.A. No. 9054.

The committee shall consider educational preparation, experience, performance, accomplishments, and reputation for honesty, integrity, incorruptibility, irreproachable conduct, and fidelity to sound moral and ethical standards.

The committee shall promulgate its own rules and regulations in the screening of applicants to carry out E.O. No. 51 and applicable laws.

The funding requirements of the committee shall be provided by the Office of the President.

It states that if any provision of the executive order is declared invalid or unconstitutional, the other unaffected provisions remain valid and subsisting. This prevents the entire order from being nullified due to a partial invalidity.

It repeals, amends, or modifies all orders, rules, regulations, and issuances, or parts thereof, that are inconsistent with E.O. No. 51.

It takes effect immediately upon its publication in a newspaper of general circulation.
