Territorial boundaries and area
- Section 2 defines the territorial boundaries of Barangay Masao.
- Barangay Masao is bounded on the North by Barangay Baluran along lines 4-5-6-7.
- Barangay Masao is bounded on the East by Sibuguey Bay along lines 7-8-9-10-11-12-13-14-15-16 and 17.
- Barangay Masao is bounded on the South and Southwest by Barangay Libertad along lines 17-1-2 and 3, and by Barangay Timbabauan along line 3-4, all of Tungawan Municipality.
- The boundary plan referenced for Tungawan Cadastre is PB-O9-0OOO19.
- Section 2 sets the metes-and-bounds description beginning at a point marked “1” and ending at point “1” (point of beginning), and states the area as 4,318,410 square meters, more or less.
- Section 2 specifies the successive course directions, distances, and point numbers from point 1 through points 2 to 17 and back to point 1.
Plebiscite conduct and supervision
- Section 3 provides that the plebiscite for Barangay Masao was conducted and supervised by the Commission on Elections (COMELEC).
- Section 3 identifies the plebiscite basis as Provincial Ordinance No. 12, series of 1991, dated October 8, 1991, issued by the Sangguniang Panlalawigan of the Province of Zamboanga del Sur.
- Section 3 states that the provincial ordinance ratified the creation of Barangay Masao as proclaimed by the Plebiscite Board of Canvassers on December 2, 1994.
- Section 3 provides that this plebiscite shall serve as substantial compliance with the plebiscite requirement under Section 10 of Republic Act No. 7160, as amended, the “Local Government Code of 1991.”
Incumbent barangay officials remain
- Section 4 requires continuity of leadership: the incumbent barangay officials of Barangay Masao continue to hold office.
- Section 4 states that incumbents remain in office until their successors have been duly elected and qualified.
Transfer of public infrastructure
- Section 5 transfers existing public infrastructure and facilities for public use located within Barangay Masao.
- Section 5 covers all such existing infrastructure and facilities at the time of the approval of this Act.
- Section 5 transfers these assets without cost or compensation to the new barangay.
- Section 5 provides that the new barangay administers the transferred public infrastructure and facilities.
Internal Revenue Allotment entitlement
- Section 6 entitles Barangay Masao to Internal Revenue Allotment (IRA) shares.
- Section 6 anchors this entitlement on Section 285 of Republic Act No. 7160, as amended, the “Local Government Code of 1991.”
Effectivity after publication
- Section 7 provides that the Act takes effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.
- Section 7 makes publication the trigger for the 15-day effectivity period.
