Educational and development functions
- Section 2 requires the University to carry out production using indigenous materials.
- Section 2 directs the University to effect technology transfer in the countryside.
- Section 2 requires the University to assist in the development of small and medium scale industries in identified growth-centers.
- Section 2 frames the University’s leadership as oriented to vocational, scientific, and technological efficiency aligned with national development goals.
Governing Board of Regents
- Section 3 establishes the Board of Regents of the Technological University of the Philippines as the governing body.
- Section 3 sets the Board composition as:
- the Minister of Education and Culture, Chairman;
- the President of the University, Vice-Chairman;
- a Representative of the National Economic and Development Authority (NEDA), Member;
- two (2) prominent citizens distinguished in the University’s professions/fields/specializations—one representing the alumni association and the other chosen from prominent citizens of Metro Manila—appointed by the President of the Philippines upon recommendation of the Minister of Education and Culture.
- Section 3 provides term rules:
- the first group of appointive regents serve two (2) years and four (4) years, respectively;
- subsequent appointees serve four (4) years;
- a permanent vacancy is filled for the unexpired term only.
- Section 3 provides attendance/representation rule: in the absence of the Minister of Education and Culture, the Minister shall authorize a representative (preferably the Deputy Minister concerned and at least a director) to sit in meetings, while the President of the University presides as Vice Chairman during those meetings.
Board policy powers and operational duties
- Section 4 provides that the Board exercises policy-making functions consistent with:
- general education policies, plans, and programs formulated by the National Board of Education and the Minister of Education and Culture; and
- general policies, plans, and programs on national and regional development issued by the National Economic and Development Authority (NEDA).
- Section 4 requires the Minister of Education and Culture, as Chairman, to ensure adoption and observance of the general educational policies, plans, and programs by the University.
- Section 5 directs the Board to exercise specific powers and duties subject to Section 4, in addition to the general powers under Section Thirteen of Act Numbered Fourteen Hundred Fifty-Nine, as amended (the Corporation Law).
Specific powers of the Board of Regents
- Section 5 empowers the Board to enact rules and regulations for University governance, provided such rules are not contrary to law.
- Section 5 authorizes the Board to receive and appropriate sums for the ends specified by law for University support.
- Section 5 authorizes the Board to import duty-free essential commodities and materials for advanced educational or technological programs as an exception to existing laws when not available locally.
- Section 5 allows the Board to receive in trust legacies, gifts, and donations of real and personal property for the University’s benefit or to aid students according to donor directions, subject to Board administration in default of donor instructions.
- Section 5 provides that donations are exempt from all taxes and are deductible items from the income tax of the donors.
- Section 5 requires the Board to approve curricula and rules and discipline drawn by the Administrative and Academic Councils.
- Section 5 authorizes degree and awards functions:
- confer degrees upon successful graduation candidates;
- award honorary degrees for recognition of learning, public service, statesmanship, or eminence in any field of specialization;
- authorize the President of the University to award certificates for completion of non-degree programs.
- Section 5 gives the Board confirmation and personnel authority:
- confirm appointments of the Vice President, Deans, Directors, Registrars, Heads of Departments, professors, and other University officials and employees made by the President;
- fix compensation, hours of service, and other duties/conditions consistent with existing laws;
- remove for cause after investigation and hearing.
- Section 5 empowers the Board to establish chairs, and provide fellowships for qualified faculty and scholarships for deserving students.
- Section 5 allows the Board to fix tuition fees and other necessary school charges it deems proper; it provides that such fees and charges, including other University income, constitute a special trust fund for the exclusive use of the University, notwithstanding contrary provisions of existing laws.
- Section 5 authorizes construction or repair of buildings, machineries, equipment, and other facilities, and purchase of supplies, materials, and equipment, with funds coming from authorized University appropriations.
Board meetings, quorum, and litigation service
- Section 6 sets quorum as a majority of all members holding office at the time of the meeting.
- Section 6 requires that quorum includes the Minister of Education and Culture (Chairman) or the President acting as presiding officer in the Chairman’s absence.
- Section 6 provides service rule for legal processes: all processes against the University are to be served on the President of the University or the President’s duly authorized representative.
Regents’ compensation and university presidency
- Section 7 provides that Board of Regents members do not receive compensation.
- Section 7 authorizes reimbursement of Board members for actual and necessary expenses incurred in attending meetings or other official functions authorized by the Board.
- Section 8 designates the head of the University as the President of the University.
- Section 8 requires presidential qualifications and appointment process:
- the President must be qualified for the position;
- appointed for a term of six (6) years by the President of the Philippines upon recommendation of the Minister of Education and Culture after consulting the Board of Regents;
- the term may be renewed for another term upon recommendation of the Minister of Education and Culture after consulting the Board.
- Section 8 provides continuity during vacancies: when vacancy occurs due to death, absence, or resignation, the Minister of Education and Culture designates an officer in charge pending appointment of the President.
- Section 8 provides that the President’s powers and duties, aside from those expressly stated, are those usually pertaining to the office of a university President.
Administrative and academic governance
- Section 9 establishes an Administrative Council composed of:
- the President of the University as Chairman;
- the Vice-President, deans, directors, and other officials of equal rank as members.
- Section 9 mandates that the Administrative Council implements policies governing administration, management, and development planning approved by the Board of Regents.
- Section 10 establishes an Academic Council composed of:
- the President of the University as Chairman;
- all professors of the University’s instructional staff as members.
- Section 10 requires the Academic Council to prescribe curricula and rules and discipline subject to Board of Regents approval.
- Section 10 requires the Academic Council to fix requirements for admission and for graduation and the conferring of degrees, subject to Board of Regents review.
- Section 10 authorizes the Academic Council to recommend students as recipients of degrees.
- Section 10 grants the Academic Council disciplinary power over students through the President or duly authorized representative, within limits of discipline rules approved by the Board of Regents.
Faculty and student rights
- Section 11 exempts members of the University faculty from any civil service examination or regulation as a requisite for appointment.
- Section 11 prohibits religious test and forbids using religious opinion or affiliation as a matter of inquiry in faculty appointment.
- Section 11 prohibits any faculty member from teaching for or against any particular church or religious sect.
- Section 12 prohibits denial of admission to the University based on sex, nationality, religion, or political affiliation.
Financial management, reporting, and accountability
- Section 13 makes the Treasurer of the Philippines the ex-officio treasurer of the University.
- Section 13 requires that all University accounts and expenses are audited by the Commission on Audit or its duly authorized representative.
- Section 14 requires the Board of Regents to file an annual detailed report on or before the fifteenth day of the second month after the opening of regular classes each year.
- Section 14 mandates filing the report with the Office of the President of the Philippines through the Minister of Education and Culture, covering progress, conditions, and needs of the University.
Implementation, property transfer, and staffing continuity
- Section 15 directs the Minister of Education and Culture to take steps necessary for the immediate implementation of the Decree.
- Section 16 transfers to the University:
- all buildings, equipment, and facilities of the Philippine College of Arts and Trades; and
- all parcels of land it occupies;
- bounded by Ayala Boulevard, San Marcelino Street, and Estero de Balete,
- including the site and building of the Research and Training Center of the Department of Education and Culture.
- Section 16 requires proclamation of an additional ten hectares out of government reservation for expansion and location of the new University site.
- Section 17 authorizes appropriation under the General Appropriations Law of such additional amount as may be necessary for University operations and expansion.
- Section 18 provides staffing continuity to avoid interruption: faculty and personnel of the college are absorbed by the University.
- Section 18 designates the incumbent president as the first President of the University, and provides that other administration officers occupy equivalent positions as provided in the Decree.
Repeal and effectivity
- Section 19 repeals or modifies laws, decrees, orders, rules, and regulations inconsistent with the Decree.
- Section 20 provides that the Decree takes effect immediately.
- Section 20 records issuance on June 11, 1978, signed by FERDINAND E. MARCOS and countersigned by JACOBO C. CLAVE (Presidential Executive Assistant).
