Responsibilities and Authority
- The Medical Division and the Human Resource and Management Division are tasked to assist in enforcing the drug testing program.
- The Administrative Department holds exclusive authority to determine the actual taking of urine samples for testing.
Procedures for Drug Testing
- Urine sample collection must be performed by personnel from a reputable and experienced drug testing institution.
- Sampling must be random and conducted at the workplace of the concerned official or employee.
Consequences of Evasion or Refusal
- Officials or employees who evade or refuse drug testing without valid and justifiable reasons will be presumed to be using prohibited substances.
- No disciplinary action shall be taken without observing due process.
- Refusal to grant access for conducting drug testing at the workplace is construed as refusal to submit to drug testing.
- Presence records (e.g., time cards) will be used to determine compliance during sample collection.
Penalties for Positive Findings
- Officials and employees found using or pushing illegal, prohibited, and dangerous drugs are subject to dismissal upon first offense.
- Proper notice and hearing are prerequisites before imposing penalties.
Effectivity
- The order takes effect upon approval by the Board.
- Officially adopted on October 5, 2004, by the Acting General Manager.
