Renaming POPCOM to CPD and Attachment to NEDA

Presidential Decree (PD) No. 79 (as amended), the “Revised Population Act of the Philippines,” created the Commission on Population (POPCOM) under the Office of the President and established its population planning and family planning functions (preamble).
Executive Order (EO) No. 188 (s. 2003) attached POPCOM to the Department of Health (DOH) (preamble).
EO No. 230 (s. 1987) identifies the National Economic and Development Authority (NEDA) as the authority primarily responsible for continuing, coordinated, and fully integrated social and economic policies, plans, and programs (preamble).
Section 84 of Republic Act No. 10964 (the General Appropriations Act for FY 2018) authorizes the President to create new offices, modify organizational structures, and create or modify positions in the Executive Branch whenever public interest so requires (preamble).
Section 17, Article VII of the 1987 Constitution provides that the President shall have control of all executive departments, bureaus, and offices and shall ensure laws are faithfully executed (preamble).

Executive Order No. 71 aims to strengthen population-related development planning and implementation by enhancing coordination of the population agency with NEDA (preamble).
Executive Order No. 71 supports integration of population and development as a strategy under the Philippine Development Plan 2017–2022 to increase the country’s potential economic growth (preamble).
Executive Order No. 71 is grounded on the need for coherent coordination of population and development in pursuit of socio-economic development reforms and programs (preamble).

Section 1 renames the Commission on Population as the “Commission on Population and Development” (CPD).
Section 1 reverts the CPD’s attachment to NEDA for policy and program coordination.
The attachment arrangement under EO No. 188 (s. 2003) to the DOH is effectively superseded to restore CPD’s coordination role with NEDA (Section 1).

Section 2 provides that an Executive Director (ED) shall be appointed in accordance with Section 10 of PD No. 79, as amended.
The ED is appointed by the CPD Chairperson, subject to the approval of the CPD Board of Commissioners (Board) (Section 2).
The ED receives emoluments attached to the rank of an undersecretary (Section 2).
The ED provides technical and administrative services to the CPD Board in accordance with the powers and duties of the ED under PD No. 79, as amended (Section 2).

Section 3 requires that the budget needed to implement Executive Order No. 71 come from available funds of the CPD for FY 2018.
For succeeding years, Section 3 requires that CPD funding requirements be included in CPD’s budget proposal.
The CPD budget proposal for succeeding years is submitted to the DBM, subject to the budgetary process (Section 3).

Section 4 revokes, amends, or modifies all executive orders, rules and regulations, and other issuances or parts thereof that are inconsistent with Executive Order No. 71.
Section 4 applies to inconsistent provisions only, with consistent parts remaining effective.

Section 5 provides that if any provision of Executive Order No. 71 is declared invalid or unconstitutional, the other provisions remain valid and subsisting.
