Rodrigo Roa Duterte's Executive Order No. 71 renames the Commission on Population to the Commission on Population and Development and reverts its attachment to the National Economic and Development Authority to enhance coordination on population-related policies and programs.

It renames POPCOM as the Commission on Population and Development (CPD) and changes its institutional attachment from the Department of Health (DOH) back to the National Economic and Development Authority (NEDA), while providing for related structural and funding provisions.

The ED shall receive the emoluments attached to the rank of an undersecretary.

The ED provides technical and administrative services to the CPD Board, consistent with the powers and duties of the ED under PD No. 79, as amended.

The budget necessary for implementation shall be sourced from available funds of the CPD for FY 2018.

For succeeding years, funding requirements must be included in the CPD’s budget proposal submitted to the DBM, subject to the budgetary process.

Section 4 states that all executive orders, rules and regulations, and other issuances (or parts thereof) inconsistent with EO No. 71 are revoked, amended, or modified accordingly.

It contains a separability clause (Section 5): if any provision is declared invalid or unconstitutional, the remaining provisions not affected stay valid and subsisting.

It takes effect upon its publication in the Official Gazette or in a newspaper of general circulation.

It invokes Section 17, Article VII of the Constitution: the President has control of all executive departments, bureaus, and offices and must ensure laws are faithfully executed. This supports the President’s authority to reorganize/adjust attachments and structure within the Executive Branch.
