Charter of the Pambansang Katipu ng Kabataang Barangay

Creation and Corporate Character

Section 2 creates a body corporate known as the Pambansang Katipunan ng Kabataang Barangay ng Pilipinas, referred to as the KB Pambansang Katipunan.
Section 2 places the KB Pambansang Katipunan directly under the Office of the President of the Philippines.
Section 2 establishes the main executive office in Metro-Manila.
Section 4 vests the Kabataang Barangay with the powers and attributes of a corporation.

Policy and Objectives for Youth Development

Section 2 frames the creation under the State’s recognition of the role of the youth in nation-building and the duty to promote their physical, intellectual social, and economic well being.
Section 3 requires the Kabataang Barangay to pursue total development of the youth consistent with the guiding philosophies of the New Society.
Section 3 mandates building social commitment and good citizenship among youth and assisting in a united front and concerted action to help government achieve national development goals.
Section 3 directs the Kabataang Barangay to supplement government efforts in preparing and training both in-school and out-of-school youth for citizenship and community life and for gainful employment opportunities.
Section 3 authorizes research, studies, training, scholarships, and consultancy for youth, and support for the printing and publication of worthy youth endeavours.
Section 3 requires the promotion and assistance of youth in sports, social and cultural activities, and in organizing youth groups, associations, and societies designed to promote the Kabataang Barangay objectives.
Section 3 permits the undertaking of any other projects or activities contributing to achievement of its general objectives.

Corporate Powers and Internal Governance

Section 4 allows the KB Pambansang Katipunan to enter into contracts.
Section 4 authorizes it to sue and be sued.
Section 4 empowers it to acquire, purchase, hold, transfer and dispose of property and to encumber the same.
Section 4 authorizes it to adopt a constitution and by-laws for internal organization and government.
Section 4 permits it to raise funds through donations, benefits, and other means for its purposes.
Section 4 authorizes adoption of training programs for youth development and payment of training expenses.
Section 4 includes the power to exercise and perform other powers and functions necessary to carry out its purposes.
Section 4 provides autonomy in management and expenditures of funds derived from projects or operations, donations, and other sources, except as otherwise provided in the Decree.

Autonomy, Coordination, and Reports

Section 4 grants autonomy in formulating policies, plans, projects and programs, subject to the availability of expert, technical, and other assistance from government offices and agencies upon request.
Section 11 provides that the KB Pambansang Katipunan is independent of all government offices and agencies in its operations.
Section 11 encourages coordination and communication with government offices and agencies but makes the KB Pambansang Katipunan solely responsible for its policies and operations.
Section 11 requires an annual report of activities, receipts, and disbursement at the end of each calendar year to the President of the Philippines.

Administration by Executive Committee

Section 5 establishes administration by an Executive Committee composed of the Presidents of the thirteen (13) regional Kabataang Barangay organizations.
Section 5 requires the Executive Committee to choose a Chairman to preside over meetings.
Section 5 mandates rotating chairmanship among members in accordance with rules and regulations, with rotation not more often than once every quarter.
Section 5 authorizes the Committee to appoint other officers, including an executive director, who exercises administrative powers and duties in consultation with the Chairman.
Section 5 obligates the Committee to promulgate rules and regulations governing organization and operations, including detailed organization, Executive Committee officers and their powers and duties, meetings, officers and employees rules, and other matters for proper operation.
Section 6 requires the Executive Committee to determine, prepare, and approve necessary staff support and staffing pattern and related details needed to attain the Kabataang Barangay purposes and objectives.

Funding Sources and Annual Budget Approval

Section 7 authorizes the KB Pambansang Katipunan to receive donations.
Section 7 authorizes the receipt of bequests.
Section 7 authorizes receipt of the net receipts from one draw of the Philippine Charity Sweepstakes Office, and authorizes the Philippine Charity Sweepstakes Office to hold one draw every year for this purpose.
Section 7 authorizes receipt of funds from other sources.
Section 8 requires the Committee to approve an annual budget for the KB Pambansang Katipunan and other operating budgets submitted by the Chairman.
Section 8 states that Committee approval of budgets is final and not subject to any other approval by any Government Office, except as provided in the succeeding Sections.

Appropriations, Release of Funds, and Control

Section 9 appropriates from any funds of the National Treasury not otherwise appropriated the sum of Eleven Million Pesos for the Calendar Year 1977.
Section 9 provides that the sum of Eleven Million Pesos is appropriated every calendar year thereafter, and continues until otherwise provided by law.
Section 10 directs that the appropriations in Section 9 are to be released to, and administered by, the Board of Trustees of the Kabataang Barangay.
Section 10 requires sufficient discretion for the KB Pambansang Katipunan in programming expenditures.
Section 10 mandates that twenty-five percent of the annual appropriations of Eleven Million pesos shall be immediately released to the Kabataang Barangay.
Section 10 mandates that the remaining seventy-five percent and incomes arising therefrom shall be released to the KB Pambansang Katipunan on a feasibility basis.
Section 10 provides that other funds of the KB Pambansang Katipunan from sources specified in the Decree and other sources are under the executive control of the Committee.

Financial Trust and Auditing

Section 12 declares the KB Pambansang Katipunan independent in operations and provides that it has control over disbursements of its funds, except as otherwise provided in the Decree.
Section 12 requires the Executive Committee to ensure financial autonomy is exercised at all levels of organization in the Kabataang Barangay, whether local, regional or national.
Section 12 declares the funds of the KB Pambansang Katipunan as a public trust to be used for the benefit of Filipino youth.
Section 12 subjects these funds to the visitorial powers given by the Constitution to the Commission on Audit.

Tax Exemption and Exempt Imports

Section 13 exempts the KB Pambansang Katipunan from all forms of taxation or other impositions, whether local or national.
Section 13 exempts the KB Pambansang Katipunan from all duties and other imposts on equipment, articles, or goods it imports when reasonably necessary for use in its operations.

Repeal of Inconsistent Rules

Section 14 repeals or modifies any provisions of decrees, orders, and other rules and regulations that are inconsistent with the Decree.
Section 14 preserves funding continuity by providing that budgetary appropriations made by different government agencies involved in Kabataang Barangay activities shall continue to be funded.
