Coverage of Booking Confirmation

  • Applies to all individual Artists and members of Performing Artist Groups.
  • Every Artist performing under contract must have a Booking Confirmation.

Required Contents of the Booking Confirmation

  • Name of Licensed Agency.
  • Name of Authorized Training Center.
  • Name and composition of the Performing Artist Group.
  • Name(s) of the Performing Artist(s).
  • Name of the Performance Venue.
  • Name of the Foreign Principal's Company including its President/Owner and POEA Accreditation Number.
  • Signatures of key parties: Licensed Agency President/General Manager, Foreign Principal, Talent Manager(s), and the Artist(s).
  • Indication of Gross Salary.

Validity and Operational Guidelines of Booking Confirmation

  • Valid for four months from the date the Licensed Agency submits artist's complete documents to the principal.
  • Upon document receipt, the principal must deposit a guarantee money of at least US$300 per artist with the Licensed Agency.
  • Artists cannot be booked with other clients or principals during the BC's validity period.
  • The Licensed Agency must provide each artist with a copy of the BC and a receipt acknowledging document submission.
  • If deployment does not occur within validity, the principal forfeits guarantee money in favor of the artist.
  • The Agency must pay artists the corresponding guarantee amount at the end of four months.
  • Artists may withdraw from the booking after the BC validity; the principal must return all submitted documents upon withdrawal.

Mechanism for Complaints

  • Complaints regarding the Booking Confirmation or its implementation can be filed with the Welfare Services Branch of the POEA Welfare and Employment Office.

Sanctions for Violations

  1. Licensed Agency Failure to Provide BC Copy and Receipt:
  • First Offense: Warning and direction to provide documents; If BC expired, also must compensate at least $300.
  • Second Offense: Suspension of documentary processing for one month.
  • Third Offense: Suspension of documentary processing for three months; incurs one demerit point.
  1. Authorized Training Center Failure to Turnover BC Copy:
  • First Offense: Warning and directive to turn over BC; If expired, must compensate at least $300.
  • Second Offense: Suspension of graduate testing schedules for one month.
  • Third Offense: Suspension of graduate testing schedules for three months; one demerit point towards authorization revocation.
  1. Artist Booking with Another Principal or Unauthorized Withdrawal:
  • First Offense: Placement on POEA watchlist, delisting only upon clearance from complainant.
  • Second Offense: Blacklisting and cancellation of Artist Record Book.
  1. Other offenses handled under existing POEA Rules and Regulations.

Booking Confirmation as a Mandatory Documentary Requirement

  • Must be submitted for the processing of individual employment contracts at POEA.
  • Serves as an attachment to the Certificate of Eligibility for submission to the Philippine Embassy or Labor Attaché's Office.

This order is mandated for strict compliance and was adopted on 2 August 1994.
