Legal basis and purpose
- Republic Act No. 7227 empowers BCDA to own, hold, and/or administer portions of the Metro Manila camps that may be transferred to it by the President under Section 4 of Republic Act No. 7227.
- Republic Act No. 7227 authorizes the sale of the Metro Manila camps transferred to BCDA in whole or in part, provided the President has approved a development plan embodying projects for conversion under Section 8 of Republic Act No. 7227.
- The Order directs review and updates to make planned land uses more responsive to Republic Act No. 7227 and to enhance benefits derived from the properties to promote national development.
- The Order ties the review to the Administration’s socio-economic development commitment and focus on uplifting the condition of the poor.
- The Order requires BCDA to ensure the MDPs support the Administration’s economic and social reform policies.
BCDA review and updating powers
- Section 1 directs BCDA to review and update and, where necessary, revise or modify the existing Master Development Plans for the Metro Manila camps transferred to BCDA under Republic Act No. 7227.
- Section 1 requires BCDA, when any camp or part of a camp has been sold, to undertake the review with the participation of its joint venture partners, property developers, and investors.
- The Order contemplates updated land uses and planning to improve responsiveness to the statutory conversion policy framework under Republic Act No. 7227.
- The Order covers major properties within former Metro Manila camps transferred to BCDA and expressly highlights Fort Bonifacio and Villamor Air Base in Section 3.
Negotiation authority to expedite planning
- Section 2 authorizes BCDA, for the purpose of facilitating and expediting the review and revision of the MDPs, to negotiate immediately with an urban planner or an urban planning firm.
- The negotiated planning engagement is intended to undertake the review and revision of the MDPs.
Submission of updated MDPs for approval
- Section 3 requires BCDA to submit to the President for his approval the updated and revised MDPs.
- The submission deadline is within two (2) months from effectivity of the Administrative Order under Section 3.
- The updated and revised MDPs must cover major properties within former Metro Manila camps transferred to BCDA pursuant to RA 7227, particularly Fort Bonifacio and Villamor Air Base.
- The updated MDPs must help promote Administration policies and programs, particularly the development of socialized and affordable dwelling units for the police and military personnel under Section 3.
Government support and inter-agency assistance
- Section 4 requires the following offices, agencies, or instrumentalities to provide support assistance to BCDA upon request for the review, modification, and implementation of the MDPs:
- Local governments where BCDA properties are located (e.g., Municipalities of Taguig and Pateros, Pasay City, and Makati City) must assist in incorporating and synchronizing BCDA MDPs with local development plans and zoning ordinances under Section 4(a).
- The Housing and Land Use Regulatory Board must assist in determining appropriate land uses and development standards and in approving zoning ordinances under Section 4(b).
- The Department of National Defense and the Armed Forces of the Philippines must assist in the speedy relocation of military facilities affected by the bases conversion program under Section 4(c).
- The Housing and Urban Development Coordinating Council and the National Housing Authority must assist in developing relocation programs for informal occupants of BCDA properties under Section 4(d).
- The Department of Interior and Local Government/Philippine National Police must assist in facilitating and ensuring peace and order in the relocation of informal occupants within BCDA properties under Section 4(e).
- The Department of Environment and Natural Resources must assist in facilitating the issuance of Special Patents or Titles and Environmental Clearance Certificates for BCDA properties under Section 4(f).
- The Department of Finance must assist in the allocation and utilization of funds needed for various relocation and development activities of the bases conversion program under Section 4(g).
- All other government offices, including Department of Transportation and Communication and Department of Public Works and Highways, must likewise extend the necessary assistance and support to BCDA in the review and modification of the MDPs under Section 4.
Repeal of inconsistent issuances
- Section 5 provides that all administrative or executive orders and department and other agency issuances inconsistent with OP Administrative Order No. 25 are deemed repealed, modified, or amended accordingly.
- The repealing clause applies to inconsistent provisions affecting the BCDA MDP review and revision directive.
Implementation timeline and effect
- Section 3 sets a planning and submission timeline requiring President-level approval within two (2) months from effectivity.
- Section 6 requires immediate implementation upon issuance by providing that the Order takes effect immediately.
