Governor-General approvals for use and sharing
- Section 1 requires prior approval by the Governor-General each time the Aviation Unit’s aircraft and facilities are used for control of pests, assistance to customs/immigration, or other expedient purposes.
- Section 2 authorizes, with prior approval in each instance by the Governor-General, the availability of Aviation Unit aviation facilities to other branches of government for official business.
- The requesting branch must defray the cost of such operation.
Chief of Constabulary powers and organization
- Section 2 charges the Chief of Constabulary with responsibility and authority to organize, train, and administer the Aviation Unit.
- Section 2 empowers the Chief of Constabulary to make rules and regulations necessary for carrying out the Act and consistent with existing law, within the limits of available appropriations.
- Section 2 authorizes the Chief of Constabulary to:
- Transfer personnel from other Constabulary divisions as necessary for organizing the Aviation Unit.
- Provide for examinations and training for Aviation Unit personnel.
- Provide appropriate grades and ratings for Aviation Unit personnel.
Personnel increases and special compensation
- Section 2 authorizes the Chief of Constabulary to increase the number of commissioned officers by not more than ten (10) officers if necessary due to the failure or unwillingness of Constabulary officers to qualify as aircraft pilots.
- This increase is authorized to achieve ten (10) commissioned officers as aircraft pilots in the Aviation Unit.
- Section 2 provides an additional compensation for officers whose duty requires regular and frequent aerial flights.
- The additional compensation equals twenty-five percent (25%) of the basic pay received by non-flying personnel of the same rank or grade.
- Section 2 authorizes enlisted personnel specifically for technical maintenance of flying equipment through an enlisted cap and pay schedule:
- Enlisted men qualifying as air mechanics must not exceed fourteen percent (14%) of the entire enlisted personnel of the Unit.
- Those air mechanics receive monthly pay of:
- Seventy-five pesos (₱75) for first-class,
- Fifty pesos (₱50) for second-class, and
- Twenty-five pesos (₱25) for third-class.
Aircraft, facilities, and operational authority
- Section 2 authorizes the Chief of Constabulary to acquire, operate, and maintain aircraft and accessories, and provide shelter, within available appropriations.
- Section 2 authorizes expenditures necessary to carry out the Act, including:
- Personnel services,
- Rent at the seat of government and elsewhere,
- Books of reference, and
- Periodicals.
- Section 2 authorizes the Chief of Constabulary, at an airport or emergency landing field owned or operated by the Philippine Constabulary, to sell and render services:
- The authority applies whenever the Chief deems it advisable and proper, and only upon previous approval of the Department Head.
- The sale covers fuel, oil, equipment, and other supplies.
- The service includes temporary shelter and mechanical service or assistance to aircraft owners or operators in emergencies.
- Section 2 restricts such sales/services to the extent reasonably necessary to allow aircraft to continue to the nearest regularly established airport where supplies and proper mechanical service are available.
- Section 2 requires that charges for sold property or rendered service be fixed under Section five hundred and seventy-two of Act Numbered Twenty-seven hundred and eleven, and that money collected be disposed of under Section five hundred and seventy-three of the same Act.
Civil aviation rules applied to Constabulary Aviation
- Section 3 applies the provisions of Act Numbered Thirty-nine hundred and nine, as amended by Act Numbered Thirty-nine hundred and ninety-six, and any acts or regulations promulgated thereunder, to Constabulary Aviation Unit activities.
- Section 3 applies these civil aviation rules to:
- Airworthiness of aircraft,
- Qualifications of airmen, and
- Air traffic rules and regulations.
Appropriation for first two years
- Section 4 appropriates five hundred nineteen thousand pesos (₱519,000) from the Insular Treasury for the first two years of operation, to carry out the Act.
- Section 4 makes three hundred thousand pesos (₱300,000) available during the year nineteen hundred and thirty-five.
- Section 4 prohibits spending any part of the appropriation for the purchase of airplanes until the Philippine Constabulary has in its service competent personnel to handle the equipment.
Effectivity date and approval
- Section 5 provides that the Act takes effect on January 1, 1935.
- The Act was Approved on December 8, 1934.
