Questions (Acts No. 4194)

Acts No. 4194, approved on December 8, 1934, created the Aviation Unit within the Philippine Constabulary.

It is created within the Philippine Constabulary and shall have and exercise functions and duties as may from time to time be prescribed and designated by the Chief of Constabulary.

Upon prior approval by the Governor-General in each instance, they may be used for control of locusts or other pests, assisting customs or immigration authorities, or for such other purposes as the Governor-General deems expedient or advisable.

The Chief of Constabulary.

He is authorized to make such rules and regulations as he may deem necessary for organization, training, and administration, as authorized under existing provisions of law, and within limits of available appropriations.

He may transfer from other divisions of the Constabulary such personnel as may be necessary for the organization of the Aviation Unit.

He may increase commissioned officers by not more than ten if necessary due to the failure or unwillingness of Constabulary officers to qualify as aircraft pilots, to have ten commissioned officers as aircraft pilots in the Aviation Unit.

An additional compensation equivalent to 25% of the basic pay of non-flying personnel of the same rank or grade, due to the high mortality rate among flying personnel.

Enlisted men qualifying as air mechanics, first-, second-, and third-class must not exceed 14% of the entire enlisted personnel of the Unit. Monthly pay: 75 pesos (first class), 50 pesos (second class), and 25 pesos (third class).

The Chief of Constabulary may acquire, operate, and maintain aircraft and accessories and provide shelter, within limits of available appropriations, as needed to execute the duties under the Act.

With prior approval in each instance by the Governor-General, to the extent he may deem advisable, and provided the requesting branch defrays the cost of such operation.

Expenditures including personnel services and rent at the seat of the Government and elsewhere, and for books of reference and periodicals, as may be provided for by the Philippine Legislature from time to time.

With prior approval of the Department Head and whenever deemed advisable, he may sell fuel, oil, equipment, and supplies; furnish temporary shelter; and render mechanical service/assistance to owners or operators of aircraft in emergencies—only as reasonably necessary to enable the aircraft to continue to the nearest regularly established airport where supplies and proper service are available.

Charges are fixed according to Section 572 of Act No. 2711, and money collected is disposed of according to Section 573 of the same Act.

The provisions of Act No. 3909 as amended by Act No. 3996 and acts/regulations promulgated thereunder governing civil aviation in the Philippine Islands apply to the Constabulary Aviation Unit as to airworthiness of aircraft, qualifications of airmen, and air traffic rules and regulations.

A total of 519,000 pesos is appropriated out of Insular Treasury funds not otherwise appropriated, with 300,000 pesos available during the year 1935.

No part of the appropriated amount shall be spent for the purchase of airplanes until the Philippine Constabulary has in its service competent personnel to handle said equipment.
