Gloria M. Arroyo's Executive Order No. 773 reorganizes the Peace and Order Council at national, regional, provincial, city, and municipal levels, enhancing its structure and responsibilities to effectively address peace and order issues, including insurgency and public safety.

Structure of Peace and Order Councils

  • Section 1 further reorganizes the Peace and Order Council on the national, regional, provincial, city, and municipal levels.
  • The Chair of the National Peace and Order Council (NPOC) is the Secretary of Interior and Local Government (SILG).
  • The NPOC members include the following:
    • The Director-General of the National Security Council (NSC)
    • The Executive Secretary
    • The Secretary of Foreign Affairs
    • The Secretary of National Defense (SND)
    • The Secretary of Justice
    • The Secretary of Agriculture
    • The Secretary of Agrarian Reform
    • The Secretary of Public Works
    • The Secretary of Social Welfare and Development
    • The Secretary of Health
    • The Secretary of Trade and Industry
    • The Secretary of Transportation
    • The Secretary of Education
    • The Secretary of Environment and Natural Resources
    • The Press Secretary
    • The Chairman of the Dangerous Drugs Board
    • The Chairman of the National Commission on Indigenous Peoples
    • The Presidential Adviser on the Peace Process
    • The Director-General, Presidential Management Staff
    • The Director-General, Philippine Information Agency
    • The Chairperson of the Presidential Anti-Graft Commission
    • The Chief of Staff of the Armed Forces of the Philippines (CSAFP)
    • The Chief of the Philippine National Police (PNP)
    • The Director of the National Bureau of Investigation
    • Three (3) representatives from the private sector, appointed by the President of the Philippines.
  • Regional Peace and Order Council (RPOC) composition includes:
    • Regional Provincial Governors, the Mayors of the Highly Urbanized Cities, the Presidents of the Leagues of Municipalities, and the regional counterparts of the departments, offices, and agencies enumerated for the NPOC in Section 1(a), where applicable.
    • The Chairman and Vice-Chairman are appointed by the SILG, with the approval of the President of the Philippines, from among council members.
    • One representative of the Mayors of the Component Cities, chosen from among themselves.
    • The Chairman of the RPOC appoints the three (3) representatives from the private sector after consultation with council members and after acquiring appropriate security clearances.
    • The regional counterpart of the CSAFP is the Commander of the Infantry Division.
    • Departments, offices and agencies with no regional and/or field offices do not sit in the RPOC.
  • Provincial Peace and Order Council (PPOC) composition includes:
    • The provincial counterparts of the departments, offices, and agencies in Section 1(a), where applicable.
    • The Provincial Governor as Chairman and the Vice Governor as Vice Chairman.
    • One representative of the Sangguniang Lalawigan, chosen by it from among its members.
    • The Chairman of the PPOC appoints the three (3) representatives from the private sector after consultation with council members, with approval of the Commander of the Infantry Division and the Regional Director of the PNP.
    • The provincial counterpart of the CSAFP is the Brigade Commander, or for Palawan, the Commander of the Western Command.
    • Departments, offices and agencies with no provincial and/or field offices do not sit in the PPOC.
  • City or Municipal Peace and Order Council (CPOC or MPOC) composition includes:
    • The city or municipal counterparts of the departments, offices, and agencies in Section 1(a), where applicable.
    • The Mayor as Chairman and the Vice Mayor as Vice Chairman.
    • One representative from the Sangguniang Panlungsod or Sangguniang Bayan, as the case may be, chosen by the Sanggunian from among its members.
    • The Chairman of the CPOC or MPOC appoints the three (3) representatives from the private sector after consultation and after acquiring appropriate security clearances.
    • Departments, offices and agencies with no city, municipal, and/or field offices do not sit in the CPOC or MPOC.

NPOC responsibilities and functions

  • The NPOC is responsible for the following functions under Section 2:
    • Contributing to strategies of the National Security Council that effectively respond to peace and order problems.
    • Coordinating and monitoring peace and order plans.
    • Providing a forum for inter-disciplinary dialogue and deliberation of major issues and problems affecting peace and order.
    • Performing other duties and functions as the President may direct.

Sub-national councils’ duties

  • The RPOCs, PPOCs, CPOCs, and MPOCs must perform the following duties and functions under Section 3:
    • Provide a forum for dialogue and deliberation of major issues and problems affecting peace and order, including insurgency.
    • Recommend measures to improve or enhance peace and order and public safety in their respective areas of responsibility, including anti-insurgency measures.
    • Recommend measures to converge and orchestrate internal security operations efforts of civil authorities and agencies and military and police.
    • Apply moral suasion to and/or recommend sanctions against local chief executives who give material and political support to the Communist rebels.
    • Monitor the provision of livelihood and infrastructure development programs and projects in remote rural and indigenous population areas adopted to isolate them from Communist rebels, including Agitate/Arouse, Organize and Mobilize and ideological, political and organization works.
    • Perform all other functions assigned by law, the President, or the NPOC.
  • Civilian Volunteer Organizations (CVOs) are managed and supervised by the respective Regional, Provincial, City or Municipal Directors of the PNP.

NPOC Secretariat and staffing roles

  • A NPOC Secretariat is established under Section 4, headed by the designated Deputy Director General (DDG) of the NSC.
  • The Secretariat handles the administrative and technical activities of the Peace and Order Council organized at various levels of government.
  • The Secretariat must also undertake liaising and coordination of activities with appropriate government agencies.
  • The DDG, NSC designated to head the NPOC Secretariat must provide synchronized, focused, and vigorous implementation of integrated efforts and affirmative actions of the government.
  • The DDG must coordinate and monitor internal security operations (ISO) convergence operations.
  • The Regional Director of the DILG heads the RPOC Secretariat.
  • At the provincial, city, and municipal levels, the PPOC, CPOC, and MPOC Secretariat is headed by the most senior DILG officer stationed in the province, city, or municipality.
  • Each level’s Secretariat is assisted by the regular staff of the Council Chairman.

Internal Security Operations coordination center

  • Each region must have a Regional ISO Coordinating Center under Section 5, under the RPOC.
  • The Regional ISO Coordinating Center focuses on coordinating internal security operations (ISO) efforts of civil authorities and agencies, military, and police.
  • The Infantry Division Commander (or his equivalent commander) acts as the Coordinating Officer.
  • The Presidential Assistant for the Region mobilizes all civilian agencies needed to coordinate with the Infantry Division Commander.

Kalayaan Barangay list amendments

  • The Kalayaan Barangay list drawn up by the Department of Defense may be amended under Section 6.
  • Amendments require approval of the Unified Area Commander.
  • Amendments must conform to the need to provide livelihood and infrastructure development programs and projects in relevant remote rural and indigenous population areas adopted to isolate them from the Communist rebels, including Agitate/Arouse, Organize and Mobilize and ideological, political and organization works.

Supersession and repealing clause

  • Section 7 provides that all prior issuances on the organization and functions of the Peace and Order Council that are inconsistent with Executive Order No. 773 are superseded by the Order.
