Legal basis and issuing authority
- Executive Order No. 393 is issued pursuant to Section 68 of the Revised Administrative Code.
- The order is issued upon the recommendation of the Provincial Board of Zamboanga del Sur.
Policy and purpose: municipal creation
- Executive Order No. 393 creates an independent municipality to be known as the Municipality of Mahayag in Zamboanga del Sur.
- The creation is achieved by organizing selected barrios and sitios into a separate municipal political unit from Molave and Dumingag.
Segregated areas and territorial coverage
- Executive Order No. 393 segregates the following barrios and sitios from the Municipality of Molave, Province of Zamboanga del Sur: Mahayag, Balanan, Bagong Dalaguat, Bagong Balamban, Cabuhi, Dilosom, Diwan, Guisapok, Dao, Lower Salug, Panagaan, San Jose, San Isidro, San Vicente, Sto. NiAo, Sicpao, Tumapic, Tuboran, Upper Sicpao, and Upper Salug Daku.
- Executive Order No. 393 segregates from the Municipality of Dumingag, Province of Zamboanga del Sur the barrios and sitios of Bongyao, Pugwan, and Yabu.
- Executive Order No. 393 organizes the segregated communities into the independent Municipality of Mahayag, with the seat of government at the barrio of Mahayag.
Municipal boundaries and delimitation method
- Executive Order No. 393 establishes the boundaries of Mahayag through an enumerated point-to-point description beginning at point 1, Km. 158 of Salug-San Isidro Road.
- The boundary tracing includes segments measured “about” meters and specified with bearings such as S-42-00-W, N-11-00-W, and a course described as due north, due south, and S-38-00-E.
- The boundary description uses river courses including Salug Daku River, Dipolo River, and the intersections with other boundary lines, including the former municipal boundary of Liargao and Molave, former municipal boundary of Dumingag and Molave, and the Provincial Boundary of Zamboanga del Norte and Zamboanga del Sur.
- The boundary description is stated as being as described by E. T. Nery, Acting Highway District Engineer of the province of Zamboanga del Sur, submitted and on file in the relevant office.
- The boundary description ends when it reaches point 1 at Km. 158 of Salug-San Isidro Road by tracing due south back to point 1.
Effect on mother municipalities’ territories and services
- Executive Order No. 393 reduces the territories of the municipalities of Molave and Dumingag by subtracting the portions included in Mahayag, as delimited by the boundary description.
- Executive Order No. 393 requires the Secretary of Finance to certify that after segregation, Molave and Dumingag can still:
- maintain creditability of their respective municipal governments;
- meet all their statutory and contractual obligations; and
- provide for essential municipal services.
Conditions for the municipality to begin existing
- Executive Order No. 393 makes Mahayag begin to exist upon the appointment and qualification of the following local officials:
- mayor;
- vice-mayor; and
- a majority of the councilors.
- Executive Order No. 393 requires certification by the Secretary of Finance that Mahayag is financially capable of:
- implementing the Minimum Wage Law; and
- providing all the statutory obligations and ordinary essential services of a regular municipality.

- Executive Order No. 393 is signed by CARLOS P. GARCIA, President of the Philippines.
- Executive Order No. 393 is countersigned by NATALIO P. CASTILLO, Executive Secretary.
- The order is dated in Manila on May 10, 1960, and references the fourteenth year of Independence of the Philippines.
