Coverage of military reservation lands
- Section 1 directs the Director of Lands to cause the subdivision of lands within military reservations that are owned by the Republic of the Philippines.
- Section 1 limits covered lands to those that the President of the Philippines declares to be no longer needed for military purposes.
- Section 3 authorizes the sale of lands so subdivided, subject to approvals and required exceptions for public service needs.
Land subdivision and lot area determination
- Section 1 requires the Director of Lands to carry out the subdivision of covered military reservation lands.
- Section 2 requires the approval of the Secretary of Agriculture and Natural Resources before the subdivision proceeds in a way that fixes lot areas.
- Section 2 requires the Director of Lands to determine the area of each lot “according to” the nature of the land, the number of prospective applicants, and the purpose for which it will be utilized.
- Section 2 makes the lot-area determination process contingent on compliance with the stated factors and the required Secretary’s approval.
Sale rules and eligible buyers
- Section 3 allows the sale of all lands subdivided except portions needed for public service, with the further requirement of the President’s approval.
- Section 3 provides that sold lands must be sold to persons qualified to acquire agricultural public lands under Commonwealth Act No. 141, commonly known as “The Public Land Act.”
- Section 3 also requires qualification under Act No. 3038 of the Philippine Legislature for eligibility to acquire the sold lands.
- Section 3 provides that the sale is subject to the President’s approval for the portions eligible for sale.
Priority in sales
- Section 3 establishes a sales-priority order in every sale of the subdivided lands.
- First priority goes to bona fide occupants of the lands.
- After bona fide occupants, priority goes to war veterans of the past war.
- The category of war veterans includes members of the USAFFE, recognized guerrillas, and deserving members of unrecognized guerrilla organizations.
Effectivity
- Section 4 provides that Republic Act No. 274 takes effect upon its approval (approved June 15, 1948).
