Policies

  • Personal use of government ICT equipment strictly prohibited even if minimal expense or non-interfering
  • No use during non-work time for personal purposes allowed
  • Use must optimize official functions and efficiency of public resources

Guidelines

Use of Equipment and Services

  • No personal use authorized regardless of magnitude of impact or expense
  • Prohibited uses include those causing communication infrastructure costs, consumables use, wear and tear, data storage, transmission impacts

Inappropriate Personal Use Includes

  • Causing network congestion or delays (e.g., large files, video)
  • Using government ICT to gain unauthorized system access
  • Sending chain letters or unauthorized mass mailings
  • Illegal/offensive activities: hate speech, discrimination, sexually explicit, illegal gambling/terrorism related materials
  • Commercial uses or outside business activities
  • Fundraising, endorsements, lobbying, partisan political activities
  • Generating more than minimal additional government expense
  • Unauthorized use/distribution of copyrighted, proprietary, or controlled information

Proper Representation

  • Prohibited from simulating official use for personal benefit or creating false impression of acting officially during non-official use

Access Management

  • No inherent right or entitlement to use government ICT equipment for personal use

Privacy Expectations

  • No right or expectation of privacy while using government ICT equipment
  • Implied consent to monitoring and disclosure, including emails and internet access
  • Authorized monitoring by designated officials for improper use

Other Prohibited Acts and Omissions

  • Allowing or tolerating unauthorized or inappropriate access/use by others
  • Failure to report such acts or omissions

Administrative Sanctions

  • Possible disciplinary, criminal, or administrative actions
  • Loss or limitation of equipment use
  • Financial liability for cost of improper use
  • Governed by existing laws and NAPOLCOM rules on disciplinary procedures

Rescission

  • Existing inconsistent policies or directives are revoked or modified

Effectivity

  • Circular effective 15 days after filing at U.P. Law Center pursuant to Executive Order No. 292 (Revised Administrative Code of 1987)
