Foreign nationals with a Temporary Visitor's Visa (TVV) who have stayed in the Philippines for six months or more are required to obtain an Emigration Clearance Certificate (ECC) before leaving the country, and this law authorizes BI offices at international ports of exit to issue ECCs to facilitate their travel.

Legal basis and governing authorities

  • The Order is issued pursuant to Book IV, Chapter 6, sections 29 and 36(2) of Executive Order No. 292, otherwise known as the Administrative Code of 1987.
  • The Order is also issued in relation to Section 3 of Commonwealth Act No. 613, otherwise known as the Philippine Immigration Act of 1940.

Policy and purpose statement

  • Foreign nationals with a Temporary Visitor’s Visa (TVV) who stayed in the Philippines for six (6) months or more must secure an Emigration Clearance Certification (ECC) before departure.
  • The Order authorizes immigration clearance processing at international ports of exit to reduce deferred departure caused by failure to secure an ECC before the intended departure.

Who may receive ECC at exit ports

  • An Emigration Clearance Certificate may be issued to a foreign national at the international port of exit if all of the following conditions are met under Section 1:
    • The foreign national is leaving within twenty-four (24) hours and has a Boarding Pass.
    • The foreign national stayed in the Philippines for six (6) months but not more than one (1) year.
    • The foreign national is a holder of a valid Temporary Visitor’s Visa (TVV).
    • The foreign national has no pending obligation with the Government, its instrumentalities, agencies and subdivisions, and has no pending criminal, civil, or administrative action which by law requires presence in the Philippines.
    • The foreign national is registered under the Alien Registration Program (ARP) and was issued a Special Security Registration Number (SSRN).

Airport Operations Division (AOD) fee collection duties

  • When the Airport Operations Division (AOD) finds that the foreign national qualifies under Section 1, the AOD through its duly authorized Collecting Officer/Cashier shall collect the ECC fees under Section 2.
  • The AOD shall collect:
    • PHP 710.00 as ECC Fee, and
    • PHP 500.00 as express lane fee.
  • If the ECC Fee was already paid upon the First TVV extension, the AOD shall collect only PHP 500.00 as Express Lane Fee.

Departure clearance and referral rule

  • A foreign national without an ECC and not qualified for issuance under Section 1 shall not be cleared for departure.
  • Such foreign national shall be referred to the nearest BI Office authorized to process and issue the required ECC.

Immigration officer border control recording

  • On primary inspection, the Immigration Officer shall indicate in the Border Control Information System (BCIS) under Section 4:
    • The Official Receipt Number/s covering fees paid at the international port of exit, or
    • The ECC Number issued by the BI Main Office or Sub-Port Offices.

Supersession and effect of inconsistent issuances

  • All circulars, memoranda, orders, and other issuances inconsistent with BOI Operations Order No. SBM-2015-009 are repealed, amended, or modified accordingly under Section 5.
