Foreign nationals with a Temporary Visitor's Visa (TVV) who have stayed in the Philippines for six months or more are required to obtain an Emigration Clearance Certificate (ECC) before leaving the country, and this law authorizes BI offices at international ports of exit to issue ECCs to facilitate their travel.

Procedures and Fees for ECC Issuance at International Ports

  • Airport Operations Division (AOD) authorized to issue ECC at ports of exit
  • Collect fees from the foreign national:
    • PHP 710.00 ECC Fee
    • PHP 500.00 Express Lane Fee
  • If ECC Fee was paid during first TVV extension, only PHP 500.00 Express Lane Fee is collected

Deferred Departure Policy

  • Foreign nationals without ECC and not qualifying under the issuance criteria are not allowed to depart
  • Such individuals must be referred to the nearest BI office authorized to process and issue ECC

Duties of Immigration Officers

  • Immigration Officer on primary inspection must record in Border Control Information System (BCIS):
    • Official receipt numbers of fees paid at international ports
    • ECC numbers issued by main or sub-port BI offices

Legal Basis and Authority

  • Issuance pursuant to:
    • Book IV, Chapter 6, Sections 29 and 36(2) of Executive Order No. 292 (Administrative Code of 1987)
    • Section 3 of Commonwealth Act No. 613 (Philippine Immigration Act of 1940)

Repealing Clause

  • All circulars, memoranda, orders, or issuances inconsistent with this Order are repealed, amended, or modified accordingly

Effectivity

  • The Order takes effect 15 days after publication in a newspaper of general circulation

Administrative Provisions

  • Copy to be furnished to the Office of the National Administrative Register and U.P. Law Center
