Foreign nationals with a Temporary Visitor's Visa (TVV) who have stayed in the Philippines for six months or more are required to obtain an Emigration Clearance Certificate (ECC) before leaving the country, and this law authorizes BI offices at international ports of exit to issue ECCs to facilitate their travel.

An Emigration Clearance Certificate (ECC) is a document required for foreign nationals with Temporary Visitor's Visa (TVV) who have stayed in the Philippines for six months or more before they are allowed to depart from the country.

The primary reason for deferred departure is the failure of foreign nationals to secure an ECC prior to their intended departure.

The order is pursuant to Book IV, Chapter 6, Sections 29 and 36(2) of Executive Order No. 292, as amended (Administrative Code of 1987), in relation to Section 3 of Commonwealth Act No. 613, as amended (Philippine Immigration Act of 1940).

The Airport Operations Division collects PHP 710.00 as ECC Fee and PHP 500.00 as Express Lane Fee. However, if the ECC Fee was paid during the first TVV extension, only the PHP 500.00 Express Lane Fee is collected.

The foreign national shall not be cleared for departure and shall be referred to the nearest BI Office authorized to process and issue the ECC.

The Immigration Officer must record either the Official Receipt Number(s) for fees paid at the port of exit or the ECC Number issued by the BI Main Office or Sub-Port Offices.

The order takes effect fifteen (15) days after its publication in a newspaper of general circulation.

All inconsistent circulars, memoranda, orders, and other issuances are repealed, amended, or modified accordingly.
