Compliance with DPWH Design Guidelines and Deviations
- Design criteria and specifications must adhere to DPWH Design Guidelines, Criteria, and Standards.
- Any deviation or modification requires approval from the BOD.
Submission and Review of Preliminary Plans
- Preliminary plans, design reports, and cost estimates must be submitted to the BOD through the DPWH Implementing Office for design concept review.
- Consultants prepare final plans incorporating BOD comments.
Requirements for Final Plans
- Each sheet of final plans must include the full name, signature, field of expertise, PRC registration number, and seal of the responsible designer.
- The Project Manager of the Consultant must sign and approve the plans before submission to the DPWH Implementing Office.
Consultant’s Responsibility for Design Failures
- A note on the cover sheet must state that the Design Consultant is fully responsible for facility failure caused by faulty design, except for changes made without the Consultant’s conformity.
- The Project Manager must sign below this note.
Acceptance and Return of Plans
- The Head of the Implementing Office, after consulting with the BOD, will return the plans as accepted for implementation.
- This acceptance does not diminish the Consultant’s responsibility for design failures.
- The Consultant must furnish a microfilm copy of the signed plans to the BOD.
Verification of Consultant Outputs and Completion Certificate
- The Implementing Office verifies that the Consultant complies with contract outputs before issuing a certificate of completion.
Approval of Revised Design Plans during Construction
- Revised plans with major changes prepared by the Construction Supervision Consultant require approval or concurrence from the original Design Consultant before submission to the BOD for conceptual review.
- Major changes include significant alignment changes, structural type changes, or introduction of new work items.
Consultant’s Liability for Additional Costs and Damages
- The Consultant is liable for additional government costs arising from major changes due to faulty or defective design.
- Negligence, fraud, or delay by the Consultant in causing changes will result in liability for damages.
- These liability provisions are to be included in consultancy agreements.
Monitoring and Reporting During Project Implementation
- Implementing Offices must evaluate the appropriateness of design plans against actual field conditions during implementation.
- Monthly reports are submitted to the PEAC Chairman and the Director of BOD until project completion.
Effectivity and Amendments
- The Order modifies inconsistent prior issuances and takes effect immediately as of February 6, 2002.
