Transfer of Personnel, Assets, Liabilities, and Records

  • All personnel employed at the Datu Danwata Elementary School - TFS of Balis Extension are transferred to and absorbed by the Balis Elementary School.
  • All assets, liabilities, and school records belonging to the Datu Danwata Elementary School - TFS of Balis Extension likewise transfer to and become the responsibility of the Balis Elementary School.

Funding and Operationalization

  • The Secretary of Education is mandated to immediately include the operationalization of Balis Elementary School in the Department of Education’s program.
  • Initial funding will be charged against the current year’s appropriations for the Datu Danwata Elementary School - TFS of Balis Extension.
  • Subsequent funding necessary to sustain the operation of Balis Elementary School shall be included in the Department’s annual budget under the General Appropriations Act.

Rulemaking Authority and Timeline

  • The Secretary of Education is required to promulgate rules and regulations to implement the provisions of this Act.
  • Such rules and regulations must be issued within sixty (60) days after the approval of the Act.

Effectivity

  • The Act takes effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation.

  • The Act was passed by the House of Representatives on November 17, 2021, and by the Senate on January 31, 2022.
  • It lapsed into law on May 29, 2022, without the signature of the President as provided under the Constitution (Article VI, Section 27 [1]).
