Composition, Appointment, and Authority of the Civil Service Board of Appeals

  • The Board consists of three members appointed by the President of the Philippines with the consent of the Commission on Appointments of the National Assembly.
  • Members must be government service personnel and hold office for one year unless sooner relieved by the President.
  • The President appoints the chairman of the Board.
  • The Board has the power to hear and decide administrative cases appealed from the Commissioner’s decisions.
  • Decisions by the Board are final unless reversed or modified by the President.
  • The Board may establish rules and regulations necessary for case management and may utilize Bureau of Civil Service employees as required.

Abolition of the Previous Civil Service Board of Appeals and Transfer of Pending Cases

  • The Civil Service Board of Appeals established under Executive Order No. 39 and confirmed by Resolution No. 45 is abolished.
  • All pending cases, appropriations, equipment, and supplies of the old Board are transferred to the newly created Board under this Act.

Effectivity of the Act

  • The Act becomes effective immediately upon approval on August 19, 1940.
