Duties and Role of the Assistant Clerk
- In cases of the death or disability of the clerk, the assistant clerk assumes the duties of the clerk until the position is filled or disability removed.
- The assistant clerk acts as deputy to the clerk of the court.
- Other duties may be assigned by the judges of the court or the clerk of the court.
- The assistant clerk operates under the general supervision and control of the clerk of the court.
Repeal of Prior Provision Regarding Clerk Duties
- The Act repeals the last sentence of Section 10 of The Land Registration Act.
- Previously, the Register of Deeds for the city of Manila was designated to perform the clerk’s duties in case of death or disability.
- This repeal transfers such responsibilities to the assistant clerk instead.
Expedited Passage of the Act
- The Act is expedited in accordance with Section 2 of "An Act prescribing the order of procedure by the Commission in the enactment of laws," passed on September 26, 1900.
- This reflects the public good requiring the immediate enactment of the law.
Effective Date
- The Act takes effect immediately upon its passage on February 3, 1903.
