Seat of Government
- Designates Barangay Sawata as the official seat of government for the Municipality of San Isidro.
Territorial Boundaries and Composition
- Defines the territorial jurisdiction and barangays composing the municipality:
- From Municipality of Asuncion: Barangays Sawata, Sabangan, Mamangan, Sto. Niño, Igangon, Kipalili.
- From Municipality of Kapalong: Barangays Dacudao, Datu Balong, Libuton, Pinamuno, Monte Dujali, Linao, San Miguel.
- Bounded by Municipality of Kapalong (north and west), Municipality of Kapalong and Asuncion (south), and Province of Compostela Valley (east).
- Clarifies that boundary disputes or territorial jurisdiction cases involving San Isidro and adjacent LGUs shall be resolved by the appropriate agency or forum.
- Until resolution, local government units currently exercising administrative supervision shall retain jurisdiction over disputed areas.
Ratification through Plebiscite
- Municipality of San Isidro shall only acquire corporate status upon ratification by majority vote in a plebiscite.
- Plebiscite conducted among qualified voters in the affected barangays and municipalities of Asuncion and Kapalong within 30 days from Act approval.
- The Commission on Elections is mandated to conduct and supervise the plebiscite.
Appointment and Tenure of Officials
- Upon ratification, the initial mayor, vice mayor, and members of the sangguniang bayan shall be appointed by the President of the Philippines.
- Appointment is made in consultation with the congressional district representative and the provincial governor.
- Appointed officials serve until elected officials qualify in the next local elections subsequent to the Act.
Internal Revenue Allotment (IRA) Shares
- In the first year of its corporate existence, San Isidro will receive IRA shares of the barangays composing it from the Department of Budget and Management.
- Subsequently, San Isidro and its barangays shall be entitled to IRA shares in accordance with Section 285 of Republic Act No. 7160 (Local Government Code of 1991).
Funding for Plebiscite
- Financial burden for conducting the plebiscite will be shared proportionately by the municipalities of Kapalong and Asuncion and the barangays that make up San Isidro.
Repeal of Inconsistent Laws
- All laws, executive orders, rules, and regulations inconsistent with this Act are repealed, amended, or modified accordingly.
Effectivity
- The Act takes effect immediately upon its approval by the President.
