Educational Scope and Programs
- The State College shall primarily provide higher professional, technical, and special instructions.
- It will promote research, extension services, and advanced studies particularly in agriculture, forestry, ecology, and allied courses.
- The existing high school on campus is transferred to the Department of Education, Culture and Sports but may operate temporarily within the college campus.
Offering of Short-term and Non-degree Courses
- The State College is authorized to offer short-term technical and vocational non-degree courses related to its areas of specialization.
Corporate Powers and Administration
- The State College shall have the powers of a corporation as per the Corporation Law.
- Its administration and corporate powers are vested in the Board of Trustees and the President, with the Board holding exclusive authority.
Composition of the Board of Trustees
- The Board consists of:
- Chairman of the Commission on Higher Education (CHED) as Chairman.
- President of the State College as Vice Chairman.
- Chairpersons of the Education and Culture Committees of both Senate and House as members.
- Director-General of National Economic and Development Authority (NEDA).
- Presidents of the faculty association, student council, and alumni association.
- At least two prominent citizens selected via a search committee.
- Specific terms apply to citizen members and elected representatives.
Board Policy-making and Educational Mandate
- The Board must align policies with the Philippine Constitution and CHED standards.
- It shall execute all powers necessary to govern the State College effectively.
Specific Powers and Duties of the Board
- Enact necessary rules and regulations.
- Manage and allocate funds.
- Import essential educational materials duty-free if unavailable locally.
- Receive and manage donations, which are tax-exempt.
- Fix tuition and other school fees.
- Oversee construction, purchase of properties, and equipment acquisition.
- Approve important academic and administrative appointments.
- Set salaries according to government compensation systems.
- Approve curricula and institutional rules.
- Confer academic degrees and honorary degrees.
- Establish branches and integration of other public schools within Lanao del Sur.
- Provide fellowships and scholarships.
Meetings and Quorum of the Board
- Board meetings shall occur at least bi-monthly.
- Special meetings can be called with proper notice.
- A quorum includes the presence of either the CHED Chairman or the President of the State College.
- Provisions exist for designated representatives to attend in absence of principal members.
Appointment and Term of the President
- The Board appoints the President after a selection process.
- The Presidential term is three years, renewable once.
- In case of vacancy, the Board may appoint an officer-in-charge pending new appointment.
- The President’s salary follows the Revised Compensation and Position Classification System.
Administrative and Academic Councils
- Administrative Council: President, vice presidents, deans, directors, and other officials implement policies.
- Academic Council: President and teaching staff (assistant professor rank and above) set curricular offerings, admission requirements, graduation rules, and student discipline.
Secretary and Treasurer
- The Secretary, appointed by the Board, also serves as secretary of the Board and keeps records.
- The Treasurer of the Philippines serves as ex officio treasurer of the State College.
Non-discrimination and Academic Freedom
- Faculty appointments cannot be influenced by religious opinions or affiliations.
- Faculty must not teach for or against any particular religious group.
- No student shall be denied admission due to sex, nationality, religion, or political affiliation.
- Faculty are prohibited from political agitation against the government; violation is grounds for dismissal.
Interim Appointment Process
- The CHED appoints the officer-in-charge pending the appointment of the college President by the Board.
Reporting Requirements
- The Board must submit annual reports detailing progress, conditions, and needs to the Office of the President, CHED, and Congress.
Transfer of Assets and Personnel
- All assets, liabilities, personnel, and facilities of the former Polytechnic College are transferred to the State College.
- Employees retain their positions, rights, and tenure security.
- Government-owned lands occupied by the institution are declared property of the State College; reversion rights to the Province of Lanao del Sur apply if the college ceases or lands become unnecessary.
Audit and Government Support
- The Commission on Audit audits all accounts and expenses.
- Heads of government bureaus/offices may loan equipment and detail employees for the State College’s use.
Affiliation and Integration of Schools
- The State College may accept affiliation or integration of existing national schools that support its objectives.
- The CHED Chairperson approves such integrations.
- Assets and obligations of integrated schools transfer to the State College.
Appropriations and Implementation
- Initial funding comes from the Adiong Memorial Polytechnic College’s current budget.
- Subsequent funding shall be included in the General Appropriations Act.
Repeal and Effectivity
- Inconsistent laws and regulations are repealed or amended accordingly.
- The Act takes effect immediately upon approval.
