Amending RA 8797 on SJDM city govt structure

Republic Act No. 9230 amends Republic Act No. 8797.
Section 1 of Republic Act No. 9230 amends Section 10(B) of Republic Act No. 8797.
Section 2 of Republic Act No. 9230 amends Section 58 of Republic Act No. 8797.
Republic Act No. 9230 provides an adjusted structure for the Sangguniang Panlungsod and sets timing for the city’s Representative District.

Republic Act No. 9230 implements legislative changes to align the city government structure of the City of San Jose del Monte with amended provisions on representation and district commencement.

Section 1 amends Section 10(B) of Republic Act No. 8797 by defining the Sangguniang Panlungsod composition as the legislative body of the City.
The Sangguniang panlungsod is composed of the city vice mayor as presiding officer, ten (10) regular sangguniang members, the president of the city chapter of the Liga ng mga Barangay, the president of the panlungsod na pederasyon ng mga sangguniang kabataan, and sectoral representatives.
In addition, there shall be three (3) sectoral representatives: one (1) from the women, and one (1) from the agricultural or industrial workers, and one (1) from other sectors including the urban poor, indigenous cultural communities, or disabled persons.
The sangguniang panlungsod determines (for the purpose of choosing the applicable sectoral representative described in the workers provision) the relevant sectoral designation within ninety (90) days prior to the holding of the local elections.
The regular members and sectoral representatives are elected in the manner provided by law, and six (6) regular members must be elected from each of the listed districts by barangays, with each district comprising a compact, contiguous and adjacent territory.
The elective members of the sangguniang panlungsod must possess the qualifications provided under Section 39 of Republic Act No. 7160.

For purposes of representation, six (6) regular members are elected from each of the following districts by barangays.
District I – Poblacion includes: Poblacio I, Ciudad Real, Dulong Bayan, Francisco Homes Guijo, Francisco Homes Mulawin, Francisco Homes Narra, Francisco Homes Yakal, Gaya-Gaya, Grace Ville, Gumaoc Central, Gumaoc East, Gumaoc West, Kaybanban, Kaypian, Maharlika, Muzon, Paradise 3, San Isidro, San Miguel, San Roque, Sto. Cristo and Tungkong Mangga.
District II – Assumption includes: Bagong Buhay I, Bagong Buhay II, Bagong Buhay III, Citrus, Fatima I, Fatima II, Fatima III, Fatima IV, Fatima V, Minuyan proper, Minuyan I, Minuyan II, Minuyan III, Minuyan IV, Minuyan V, San Martin I, San Martin II, San Martin III, San Martin IV, San Pedro, San Rafael I, San Rafael II, San Rafael III, San Rafael IV, San Rafael V, Sta. Cruz I, Sta. Cruz II, Sta. Cruz III, Sta. Cruz IV, Sta. Cruz V, Martin De Pores, Sto. NiAo II, Lawang Pare and Sapang Palay Proper.
The district requirement applies for representation in the sangguniang panlungsod, with each district comprising a compact, contiguous and adjacent territory.

Section 2 amends Section 58 of Republic Act No. 8797 by setting the rule for the City’s Representative District.
The City of San Jose del Monte has its own representative district.
The representative district commences in the next national election after the effectivity of this Act.

Section 3 provides that the election of the regular members of the sangguniang panlungsod, as provided in Republic Act No. 9230, and the first election for Representative of the Lone District of the City of San Jose del Monte coincide with the regular elections in 2004.
Section 3 provides that the incumbent Representative continues to represent the City of San Jose del Monte until the expiration of his term of office.

Section 4 provides that Republic Act No. 9230 takes effect upon its approval.
