Deadlines for VOS for Landowners in CARP Phase III
- Landowners with holdings above 24 hectares up to 50 hectares subject to acquisition by June 15, 1992, have until June 15, 1991, to avail of VOS.
- Landowners with holdings from the retention limit up to 24 hectares subject to acquisition by June 15, 1994, have until June 15, 1993, to avail of VOS.
Applicability and Procedures for Pending VOS Transactions
- VOS transactions pending before the DAR with no payment made are subject to notice and hearing requirements under Administrative Order No. 12, Series of 1989.
- VOS filed before June 15, 1988, follow the procedures of Executive Order No. 229.
- VOS filed after June 15, 1988, follow procedures under Republic Act No. 6657.
Role and Procedures of the Municipal Agrarian Reform Officer (MARO)
- Landowners or representatives must complete and submit CARP VOS Forms Nos. 1 and 1.a to MARO.
- MARO prepares the Voluntary Offer Claim Folder (VOCF) and requests additional documents per Administrative Order No. 3.
- MARO, assisted by Barangay Agrarian Reform Council (BARC) and Land Bank Field Representative, conducts ocular inspection and prepares investigation and evaluation reports.
- MARO ensures completeness of applicant and beneficiary forms and certifies their accuracy along with BARC and LBP representatives.
- MARO conducts a preliminary conference and submits the case folder to the Provincial Agrarian Reform Officer (PARO).
- MARO must complete the process within 30 working days from receipt of all required documents.
Role and Procedures of the Provincial Agrarian Reform Officer (PARO)
- Upon receipt of case folder from MARO, PARO follows procedures in Administrative Order No. 12, except valuation of lands voluntarily offered before June 15, 1988, which follows Administrative Order No. 5, Series 1988.
- PARO completes processing within 10 working days and forwards case folder to DAR Central Office via Bureau of Land Acquisition and Distribution (BLAD) or Regional Director (RD) for lands not exceeding 10 hectares.
Role and Procedures of the Bureau of Land Acquisition and Distribution (BLAD) or Regional Director (RD)
- Reviews, evaluates, and determines property valuation within 5 working days of receipt from PARO.
- Prepares a Summary Review and Evaluation Report (CARP VOS Form No. 8) detailing compensation, factors considered, and computations.
- Submits report and VOCF to Land Bank of the Philippines (LBP) President.
- Prepares Notice of Acquisition for signature of DAR Secretary.
Role and Procedures of the Land Bank of the Philippines (LBP)
- LBP President reviews VOCF and may recommend adjustment of compensation.
- If agreeing with the amount, LBP President signs and transmits the Summary Review and Evaluation Report to BLAD and RD.
- If disagreeing, he notifies DAR Secretary stating reasons and proposed amount.
- A DAR-LBP Committee meets monthly to reconcile differing compensation proposals and recommends final amount.
Further Role of the Bureau of Land Acquisition and Distribution (BLAD)
- Presents Notice of Acquisition for DAR Secretary’s signature.
- Serves Notice of Acquisition to landowner by personal delivery or registered mail; posts copies in municipal building and barangay hall.
- Notice includes DAR valuation; landowner must accept or reject in five days.
- Rejection or no response leads to compulsory acquisition and processing under Administrative Order No. 12.
- Acceptance or failure to reply leads to preparation of Order of Acquisition and Deed of Transfer for signatures by landowner, DAR Secretary, and LBP President.
- If landowner rejects the price, DAR Adjudication Board conducts a hearing to determine just compensation.
- Upon DARAB decision, BLAD prepares acquisition documents for signing by LBP President and DAR Secretary.
Role of the Office of the Secretary of Agrarian Reform
- Upon receipt of acquisition documents, follows procedures in Administrative Order No. 3.
- Signs Order of Acquisition and Deed of Transfer.
- Transmits documents to LBP President for execution of registration and payment.
Role of the Land Bank of the Philippines (LBP) Upon Finalization
- Observes procedures in Administrative Order No. 3 regarding payment and trust account deposit.
- Ensures payment to landowner or deposit of compensation within 20 working days of receipt of acquisition documents.
Land Valuation Standards
- Valuation follows DAR Administrative Order No. 6, Series of 1989, subject to future amendments.
Amendments and Repeals
- Administrative Order No. 3, Series of 1989, is amended only as inconsistent with this Order.
- Other orders, rules, and regulations inconsistent with this Order are repealed, amended, or modified accordingly.
